What does the temporary residence permit status give?

Important! The legalization of a foreign citizen in the Russian Federation takes place in several stages, the first of which is obtaining a temporary residence permit (TRP). Based on this document, a foreign person has the opportunity to work and stay in the Russian Federation until he is issued a residence permit (RP). If a foreigner does not plan to apply for a residence permit, then after the expiration of the temporary residence permit, he is obliged to leave the country.

As a rule, a temporary residence permit is not issued as a separate document. Usually it is a stamp that is affixed to the national passport of a Ukrainian. Such a stamp contains the inscription “temporary residence allowed” and the following information is indicated: the citizen’s full name, his citizenship, gender, date of decision and number, validity period, as well as the organization that put this stamp.

The procedure for obtaining a residence permit after a temporary residence permit in 2021

Extension of a temporary residence permit in Russia implies obtaining a residence permit. There are several stages of the procedure:

  1. Obtain a temporary residence permit and stay in the country with this status for at least 1 year.
  2. Collect a package of documents, submit them to the Federal Tax Service and fill out a form for a residence permit.
  3. Notify immigration authorities of your status annually.
  4. Get a residence permit.

According to the norms of migration law, you can write an application no earlier than a year from the beginning of your residence in the Russian Federation, but no later than 6 months before the expiration of the temporary residence permit. How to obtain a temporary residence permit for citizens of Ukraine

The procedure by which Ukrainians receive temporary residence permits will not differ from the procedure that citizens of other countries must follow. First of all, a foreigner will need to fill out a migration card at the border. This card will be proof of legal entry into the country. Within seven days after arrival, a foreigner must contact the migration authority (GUVM of the Ministry of Internal Affairs of Russia) to register. The responsibility for carrying out such a procedure falls on the receiving party, that is, on the person who received the citizen of Ukraine. After submitting the notification, the Ukrainian has the right to stay in the Russian Federation for 90 days. You must submit an application for a temporary residence permit within this period. Obtaining a temporary residence permit for citizens of Ukraine will look like this:

  • Preparation of necessary documents;
  • Passing a medical examination;
  • Passing an exam in the Russian language, history and legislation of Russia;
  • Submitting an application and required documents;
  • Passing fingerprinting, obtaining temporary registration;
  • Placing a temporary residence permit stamp on a Ukrainian passport.

Important! Documents confirming the completion of the medical examination can be provided after submitting the application within 30 days. It should be remembered that the presence of dangerous infectious diseases (for example, HIV) leads to refusal to obtain a temporary residence permit.

Is it possible to extend the temporary residence permit in Russia?

The stay of migrants in Russia is regulated by Law No. 115-FZ. The legislation directly establishes the standard validity period of a temporary residence permit (36 months) and the impossibility of extending the document. After its expiration, the foreign citizen must either leave the country and go through the registration procedure again, or obtain a residence permit/citizenship. There are no other registration or renewal options.

Important! Any organizations that promise to extend a temporary residence permit in Russia directly are scammers, since such a procedure is not provided for either by Russian law or by the regulations of the migration service.
Nevertheless, the public demand for an extension of the temporary residence permit still exists, so law firms still provide such a service. When applying, you should find out what exactly is meant by renewal - receiving a new document after canceling the old one or assistance in registering a residence permit.

Obtaining a residence permit after temporary residence permit

To obtain a residence permit, the holder of a temporary residence permit must submit an application to the migration service no later than six months before the expiration of the permit.

  • Personal income tax certificate or any other proof of stable income;
  • Confirmation of housing availability;
  • Current employment contract;
  • Original TIN.

To apply for a permit again, you must wait until the document expires and leave the country. Departure must be calculated so that it occurs while the permit is still active, and you can enter back when the document has already expired. You cannot apply for permission in advance, but you can prepare all the necessary documents.

It is not necessary to quit your job if the employer can issue a work permit for a foreigner under a quota. If this is not possible, you can apply for it yourself - an expired temporary residence permit does not interfere with this in any way.

Re-execution of documents is no different from the original one. The second three-year term does not have any advantages or disadvantages compared to the first; all the same documents and registration conditions are required for registration. If the previous temporary residence permit was canceled or the request for receipt was rejected, you are allowed to submit the application again one year from the date of the previous application. If the deadline expires, there are no such restrictions; you can send an application immediately after the previous one expires.

  • Citizens of other countries born in the RSFSR or the Russian Federation;
  • Having disabled children/parents who are citizens of Russia;
  • Married to a citizen of the Russian Federation;
  • Those who entered military service;
  • Large investors.

In other cases, re-registration will have to be carried out within a limited annual quota, proving its usefulness and promise for the country at an interview.

Pros and cons of different options

Each method has its noticeable disadvantages. Thus, obtaining a residence permit is possible if at least six months are left until the end of the period. In most cases, for those who are interested in the issue of extending a temporary residence permit, it is already too late to obtain a residence permit.

A temporary residence permit is issued up to six months in advance. During this time, a foreigner may lose his job, problems with housing and municipal services may arise.

The third, intermediate path is obtaining a visa and work permit. For residents of the CIS countries, these documents are relatively easy to obtain, and they will help the migrant not to lose his hard-earned achievements.

Documents required to obtain a temporary residence permit

Important! First of all, Ukrainians will have to translate all documents into Russian and have the translations certified by a notary.

The list of documents required to obtain a temporary residence permit will be as follows:

  • Application (drawn up in two copies);
  • Photo (4 pcs);
  • Passport (national passport);
  • International passport (if you have one);
  • Migration card;
  • A certificate confirming that the applicant does not have dangerous infectious diseases;
  • A certificate confirming successful passing of the Russian language exam, or a document confirming exemption from taking such an exam;
  • Marriage certificate (if available);
  • A document confirming migration registration;
  • Receipt confirming payment of the state duty.

Cost and timing of registration of temporary residence permit

In order to obtain a temporary residence permit, you will need to pay a state fee. Its size is 1600 rubles. In addition, some procedures during registration may also require material investments. For example, you will have to pay 5,300 rubles to take a comprehensive exam, and a medical examination will cost about 3,000 rubles. In addition, you will have to pay for the translation of documents, their certification by a notary, as well as photocopies of some papers.

Important! After submitting the application and documents, the migration authority will consider and check them for about two months. If a positive decision is made, within 7 days you will need to undergo a fingerprinting procedure and also register at your place of stay. After this, the temporary residence permit stamp will be affixed to the Ukrainian passport.

If the provision of a temporary residence permit is refused, the foreign person will be obliged to leave the Russian Federation; Russian legislation does not provide for an appeal against the refusal to provide a temporary residence permit.

How to extend a temporary residence permit for citizens of Ukraine

After a foreign person receives a residence permit in the Russian Federation, he will need to comply with certain formalities.
These include an annual notification from the migration authority that the citizen remains at his registration address and has not left Russia. This will need to be done twice in total. Notification must be provided at the end of each year within two months. Later notification periods are possible only if there are particularly valid reasons. Submitting a notification of residence in the Russian Federation

The annual notification of confirmation of residence under a temporary residence permit is a procedure necessary to comply with migration rules. Annual confirmation should be carried out 2 times. However, this procedure is not an extension of a temporary residence permit.

The migrant is obliged to contact the employees of the department of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs on migration issues, whose employees issued the temporary residence permit. Notification is given during a personal visit, via mail or the Internet. Confirmation of residence and receipt of income in the territory of a particular region should be done after a year or two after the issuance of a temporary residence permit.

The minimum income to confirm a temporary residence permit must be equal to the subsistence level. Pensioners, students, and disabled people do not have to confirm their income. They are not exempt from giving notice.

In a critical situation, foreigners are interested in whether it is possible to extend the temporary residence permit without crossing the border of the Russian Federation. This possibility is provided only in exceptional cases. If there is evidence of a force majeure situation and the inability to travel outside Russia, the period of stay under the permit will be extended to 180 days (No. 115-FZ Art. 5). However, such cases are extremely rare.
