What is a temporary residence permit and for what period is it issued?

Most foreign citizens who came to Russia to perform work duties plan to stay here for a long time. In order to legally stay in our country, you must obtain a temporary residence permit.

The visualization of such permission depends on whether the person has citizenship or not. If you have citizenship, then the permit is a stamp in the passport, but if you do not have citizenship, then the permit takes the form of a paper document and is handed to the applicant.

From November 1, 2021, changes took place and came into effect regarding the procedure for the stay of citizens of other countries in Russia. Basic Law No. 115-FZ, which regulates such relations, has been amended, enshrined in Law No. 257-FZ of August 2, 2019.

A temporary residence permit for a foreigner is valid for three years, after this period you can obtain a residence permit.

From November 1, 2021, in accordance with paragraph 4 of Article 6 of Law No. 115-FZ, an application for a permit is considered within 4 months for those foreigners who entered Russia with a visa. In a simplified procedure (visa-free regime), the application is considered within 60 days, in accordance with paragraph 8 of Article 6.1 of Law 115-FZ.

You also need to take into account that in accordance with Article 7 of Law No. 115-FZ, the permit will not be issued or will be canceled in the following cases:

  • If a citizen poses a threat to the security of our country
  • In case of providing false documents
  • If you have had or have a criminal record
  • If a foreigner has been repeatedly brought to administrative responsibility
  • If a foreigner has previously been expelled or deported from Russia
  • If a foreign citizen has not worked within a year from the date of receipt of the temporary residence permit

Residence permit in the Russian Federation

The closer the end of the three-year period of validity of the temporary residence permit is, the more often a foreign citizen thinks about further actions. The Internet is full of queries like “how to get a new temporary residence permit if the old one has expired”, “the temporary residence permit is running out, what to do”, “how much does it cost to renew the temporary residence permit” and the like. As we have already found out earlier, if you have lived in the Russian Federation for three years on the basis of a temporary residence permit, and its validity has expired, you will have to choose one of two things: either apply for a residence permit (hereinafter referred to as residence permit), or return to your homeland. Here everyone makes their own decision. And if everything is clear with the last option, then the first requires a brief explanation.

Generally speaking, it is not at all necessary to wait until the expiration of the temporary residence permit to submit an application for a residence permit. The main requirement is to live at least a year in the Russian Federation. Some categories of citizens are exempt from this obligation.

Unlike a temporary residence permit, a residence permit is issued for 5 years and can be extended an unlimited number of times.

Quotas for temporary residence permits for foreign citizens in 2021

As already mentioned, the Russian Government controls the influx of foreign workers and sets certain limits beyond which it is not allowed.

The numbers are not taken out of thin air; they are derived based on the nuances inherent in the labor market in a particular region, as well as according to the priority right of citizens of our country to get a job.

The indicators for 2021 are set out in Government Decree No. 1271 of September 30, 2019.

In total, 60,270 temporary residence permits can be issued in Russia in 2021. This is almost 23 thousand fewer permits than in 2021

. It is worth keeping in mind that in Moscow and St. Petersburg the number of permits remained the same (2000 and 1500 units), and in Sevastopol, half as many foreigners will be able to obtain permits as last year - only 300 units.

It is important to remember that the permit must be issued in the year in which such a quota was received.

Registration renewal

All foreign citizens must register for migration, that is, obtain registration. However, it happens that if you have a valid permit, the registration period ends. In such cases, it is extremely important to renew registration on the basis of a temporary residence permit. To do this, you need to come to the department of the Ministry of Internal Affairs, submit the appropriate application, presenting a passport (or other identification document), a valid temporary residence permit and documents giving the right to use residential premises.

Since foreign citizens, due to various reasons and circumstances, are faced with the need for periodic visits to their homeland, they are certainly concerned about whether it is possible to extend the temporary residence permit without crossing the border of the Russian Federation. The answer to this question is this: regardless of where you are - on the territory of Russia or outside it - you cannot extend the temporary residence permit.

Reasons why temporary residence permits are issued

A permit for a foreigner can be issued in two cases:

  • If a quota is received
  • For other reasons, without receiving a quota

In a situation where a foreign citizen has achieved a quota for obtaining a temporary residence permit from the Russian Government, no additional questions or problems will arise.

However, permission can be obtained without taking into account the quota. Such cases are specified in paragraph 3 of Law No. 115-FZ (as amended). TRP without a quota can receive:

  1. Foreigners who are immediately issued a residence permit on the basis of paragraph 2 of Article 8 of Law No. 115-FZ
  2. A minor and his parent - a foreigner (or guardian), for the duration of the temporary residence permit for an adult
  3. For a minor and a parent (guardian), if they apply for a permit at the same time
  4. The spouse of a Russian citizen, if he lives on the territory of the spouse - a Russian citizen
  5. Adults who are incapacitated or have limited legal capacity and live with a foreigner parent who has a temporary residence permit
  6. Those who invest in the economy of our country in a certain volume. The amount of investment is determined by the Government of Russia
  7. Military personnel for the duration of their service
  8. Those participating in the resettlement program
  9. Those who have citizenship of a country formerly part of the USSR and received education at a higher or secondary state educational institution in Russia

The permit is a document on the basis of which a residence permit is issued. You can get it by living in Russia for at least 1 year.

Permit renewal is a myth invented by scammers

The validity period of a temporary residence permit is strictly prescribed by law. The status is valid for exactly three years, as specified in paragraph 1 of Article 6 of Federal Law 115 “On the Legal Status...” . The extension is not provided for by any legislative act.

How to renew registration under temporary residence permit - step-by-step algorithm

The essence of the extension procedure is as follows:

  • submission of papers by a foreign citizen to the Main Directorate for Migration of the Ministry of Internal Affairs;
  • receiving a decision after reviewing the application and marking it in the passport.

You can renew your temporary residence permit only once, just like your registration. When the deadline expires again, migrants must submit an application for a residence permit to the migration service, otherwise their stay in Russia will be considered illegal, which will lead to deportation. Therefore, visitors need to know a clear procedure after crossing the Russian border.

When to apply for renewal

A foreign citizen must contact the Main Department of Migration Affairs of the Ministry of Internal Affairs at the place of temporary registration six months before the expiration date of the temporary residence permit. There, at the specified time, an application to extend migration registration at the place of residence is submitted. In the absence of these actions without reasons that the control authorities consider valid (for example, inpatient treatment), the temporary residence permit will be canceled and the migrant will have to leave the country.

To obtain a residence permit in the Russian Federation for another 3 years, a visitor must present to the migration service specialists:

Extension of temporary residence permit

Obtaining a permit is the initial step of a foreigner towards obtaining Russian citizenship. Almost every foreigner who comes to our country needs a permit.

The maximum period for which a permit is issued is three years (Article 6 of Law 115-FZ), depending on the situation. What to do after the permit has expired? When the permit expiration date approaches, you have two options:

– obtain a residence permit

– issue a temporary residence permit again

The possibility of extending a temporary residence permit is not provided for at the legislative level. The temporary residence permit cannot be extended.

During the period of validity of the permit, it is necessary to obtain a residence permit, or, after the expiration of the old one, submit documents for the permit again.

It is imperative to remember that if a residence permit is not obtained during the period of validity of the permit, then the foreigner must have time to leave Russia while the temporary residence permit is still valid. The temporary residence permit for a foreigner expires on September 15. He did not have time to obtain a residence permit. In this regard, the foreign worker must leave the country no later than September 15. He will be able to return to Russia on September 16. Moreover, the basis can be indicated the same as when receiving the first permit. But you will have to get the quota again.

What is an annual notification of residence in the Russian Federation?

Foreign citizens who have issued a temporary residence permit are required to annually notify the migration authorities of their residence in the territory of the Russian Federation. This procedure is carried out throughout the validity period of the temporary residence permit.

Notification procedure:

  1. After a year has passed from the date of issue of the temporary residence permit, the obligation to contact the Ministry of Internal Affairs with a notification begins. This can be done within two months from the date of expiration of the annual permit.
  2. The notice contains:
      last name, first name and patronymic (if any) of the foreign citizen;
  3. his place of residence;
  4. place of work and period of work for the reporting year;
  5. the period for which the foreign citizen traveled outside the Russian Federation during the reporting year (of course, if he did).
  6. One of the following documents must be attached to the notification: a certificate of income, a copy of the tax return or another document containing data on the amount and source of income for the year that has passed since the issuance of the temporary residence permit. It is important to know that if income is confirmed by a copy of the tax return, the foreign citizen is not required to provide it. Employees of the Ministry of Internal Affairs department will independently request a declaration from the tax office at the citizen’s place of registration.

It is important not to confuse the notification procedure with the extension of a temporary residence permit, especially since the second concept is generally absent in migration documents.

So, if the question arises, what documents are needed to extend the temporary residence permit in a year, then there is absolutely nothing to worry about and rush to the Ministry of Internal Affairs with a bunch of documents: you just need to notify the migration authorities that you still live in the territory of the Russian Federation and have source of income.

How to submit a notification

The notification can be submitted either in person to a department of the Ministry of Internal Affairs or using electronic services (Public Services Portal). In any case, be prepared to present a passport (or other equivalent document) and a temporary residence permit. Naturally, when applying in person, you need to have these documents with you, and if you send a notification electronically, attach scanned copies of them.

When?

It happens that for some reason it is impossible to submit a notification on time. But even if you find yourself in such an unpleasant situation, it is still possible and necessary to comply with the requirements of the law. True, even for such cases there is a maximum period for contacting the Ministry of Internal Affairs - the notification must be submitted no later than 6 months from the date of expiration of a year counting from the date of issue of the temporary residence permit.

In addition to the documents already mentioned, it will be necessary to provide those that confirm that the established period of 2 months was violated for valid reasons.

Responsibility for violating the rules of residence in Russia

Since issues related to the presence of foreign citizens in Russia are strictly regulated by the state, a system of penalties is provided for violation of legislation in this area.

Article 18.8 of the Code of Administrative Offenses regulates violations related to the regime of stay in Russia. According to this article, if a foreigner violates the entry procedure or rules for staying on the territory of our country, then administrative punishment is provided in the form of a fine from 2,000 to 5,000 rubles. Expulsion from the country is also possible.

If a foreigner does not have documents that confirm his legal status in Russia, then a fine of 2000-5000 rubles is imposed and deportation is carried out.

If a foreigner is in Russia for a purpose other than that specified upon entry, he faces a fine of 2,000-5,000 rubles and possible deportation from the country.

If the above violations were committed in Moscow, St. Petersburg or in the Moscow and Leningrad regions, then the fine will range from 5,000 to 7,000 rubles and expulsion is also possible.

Repeated violations committed within a year are punishable by fines from 5,000 to 10,000 rubles (depending on the violation) and deportation.

If a refugee or forced migrant violates the law, a fine of 200-4500 rubles is imposed.
