Documents for extending a residence permit in Russia: what are needed and how to fill out an application for extension of a residence permit?

A foreign citizen is required to obtain a permit to legally stay in the country and carry out any activity. In the Russian Federation, this includes, among other things, a residence permit (residence permit). This document allows a foreigner to live in Russia, find a job, study, use medical services and other social benefits.

Extension of residence permit in Russia due to coronavirus

Due to the coronavirus epidemic, Russia has closed its borders.

For foreign citizens who are in the country on a visa, registration for temporary stay or residence permit, the permitted period for staying in Russia will be extended, as reported on the official website of the Ministry of Internal Affairs of the Russian Federation dated March 19, 2021.

You can also renew your registration for those whose registration has expired.

To do this, you need to contact the nearest territorial department of the Ministry of Internal Affairs of the Russian Federation.

Labor migrants can apply for a patent without leaving the Russian Federation, even if work was not initially their stated purpose of entering the country.

Reasons for refusal

The issuance of a residence permit is not a guarantee of its renewal. Having received an application about a foreign citizen’s desire to extend the validity of this document, specialists from the Migration Department of the Ministry of Internal Affairs will re-check this migrant and make a negative decision if the following are identified:

  • the migrant's inability to support himself and his dependents;
  • the fact of participation in activities aimed at violating the state integrity and political system of the Russian Federation;
  • facts of violation of the administrative or criminal code;
  • long-term stay (more than 6 months per year) outside the country, not agreed with the authorities dealing with migration issues;
  • dissolution of a marriage that previously served as the basis for granting a residence permit;
  • lack of territory for living;
  • the presence of diseases that pose a danger to others.

The decision made by the employees of the Department of Internal Affairs of the Ministry of Internal Affairs must be communicated to the applicant for the extension of the residence permit in writing. 3 business days are allotted for preparing a response from the date of its issuance. In case of refusal, the previously paid state fee is not refunded.

Why is it issued?

Those foreign guests who plan to stay in Russia for a long time or stay here for a long time need to obtain a residence permit. A residence permit will be required in the following cases:

  • Works.
  • Studies.
  • Long-term treatment.
  • Subsequent acquisition of citizenship.
  • Other types of activities requiring a long stay in the Russian Federation.

Within the framework of Federal Law No. 257-FZ of 08/02/2019, a residence permit is now issued for an unlimited period. But the main conditions for obtaining it are legal stay in the state for one year, as well as, in many cases, the presence of a temporary residence permit in Russia (TRP) .

Upon receipt of a residence permit, a foreigner can leave Russia and return to the country, acquiring the rights and obligations that Russians have.

Indefinite residence permit in Russia

The migrant is required to undergo a medical examination, take tests, and attend procedures to establish that he does not have drug addiction or infections that are dangerous to others. The Ministry of Health of the Russian Federation establishes a list of diseases, the presence of which is an obstacle to obtaining a residence permit. The issuance of conclusions after a medical examination is carried out on a special form.

Note!

Each certificate from a medical institution must be used within a certain period. If it becomes invalid, the tests will have to be taken again to get a new conclusion.

For persons of certain categories, a simplified procedural procedure and reduced deadlines apply. These are the following categories of citizens:

  • refugees;
  • participants of the Compatriots State Program;
  • native Russian speakers;
  • highly qualified foreign workers.

In some cases, obtaining a residence permit does not require prior receipt of a temporary residence permit. The law allows you to obtain a residence permit without a temporary residence permit:

  • foreigners who return to their homeland because they lived in the territory of the former USSR, current or imperial Russia, speak Russian at a level sufficient for communication;
  • migrants who need political asylum in the Russian Federation;
  • Belarusians;
  • foreign highly qualified workers with an annual income of at least 2 million rubles, specified in the contract or employment contract.

For preferential categories, the waiting period for a decision on issuing a residence permit has been reduced:

  • highly qualified foreign workers wait 3 months for a decision;
  • migrants who arrived in Russia to obtain political asylum - 15 days;
  • Belarusians who came to Russia for permanent residence - 3 months;
  • participants of the Compatriots State Program - 2 months;
  • foreigners who have documented kinship with residents of Russia, native Russian speakers - 2 months.

If the migration department delays issuing a residence permit, you can contact the head of the unit, the prosecutor's office and the President's reception.

As of November 9, 2021, a new sample application for a residence permit has been approved. The form must be filled out by hand or on a computer. The applicant puts the date and signature after checking the correctness of its completion by an employee of the migration department in his presence. If the UVM employee does not make any claims to the information contained in the application form and attached documents, translations, seals, or notarization, the applicant will only have to wait for the decision on granting status.

After obtaining a residence permit, a stateless person must annually visit the migration service to confirm his location in the country.

In case of crossing the border of the Russian Federation, he must inform the migration authority about this, as well as notify about the dates of departure and return, and the purposes of the trip abroad. If a stateless person is absent from Russia for more than 6 months a year, his status is cancelled.

When preparing documents, it is important to fill out the application correctly, do not forget to translate foreign papers, and attach the documents provided for by the new Administrative Regulations on granting this status. Most often, migrants are rejected for the following reasons:

  • blots on the application form;
  • fake information;
  • invalidity of a foreigner’s internal passport;
  • application of not all documents provided by the Main Directorate for Migration of the Ministry of Internal Affairs;
  • violation of the laws of the Russian Federation;
  • information about the applicant’s involvement in terrorism and extremism;
  • The temporary residence permit expires in less than six months;
  • lack of income for the migrant;
  • fictitious marriage between a foreigner and a Russian citizen;
  • infectious diseases detected during examination;
  • lack of housing when a foreigner has been in the Russian Federation for more than 3 years;
  • outstanding criminal record;
  • travel outside the Russian border for more than 6 months;
  • deportation from the Russian Federation within 5 years.

Procedure

  • Have a temporary residence permit or other grounds for obtaining a residence permit.
  • Live in the Russian Federation on the basis of a temporary residence permit for at least 1 year.
  • Prepare the required documents. Prepare and submit documents no earlier than 8 months after receiving the temporary residence permit and no later than 4 months before its expiration date.
  • Get a residence permit.
  • Within 7 working days, register at your place of residence.
  • Notify annually of residence in the Russian Federation and period of stay outside the country.

How to get the service?

To replace a temporary residence permit with an indefinite one in 2021, you only need to take a few steps. To begin with, you will have to collect a small package of documents (about half of what was submitted during the initial registration). To obtain a new residence permit, they pay the same state fee (5 thousand rubles).

Methods for applying and receiving results

An application for extension can be submitted in person to the Migration Department of the Ministry of Internal Affairs nearest to you, sent by registered mail, or sent online through the State Services portal.

For personal submission:

  1. Select the district office of the Main Department of Migration Affairs of the Ministry of Internal Affairs of Russia at your place of residence.
  2. Fill out the application form on site (download a sample here).
  3. Pay the state fee at the cash desk and submit a package of documents (application, passport, photo, old residence permit).

The result will be the issuance of a completed permanent residence permit document. It can be picked up in person at the Ministry of Internal Affairs office.

To apply online:

  1. Log into your personal account on the State Services website: www.gosuslugi.ru.

  2. Select the option “Extension of residence permit” and fill out the online form.

After submitting your application, expect an invitation for an interview. You need to have original documents, a passport and money to pay the state fee. Due to the coronavirus pandemic, appointments are by appointment only.

The result of the service is the same - receiving a residence permit document without an expiration date. It will most likely be issued on the same day upon personal application by the applicant.

Sending documents by mail is also possible:

  1. To do this, create a package: fill out the application form (see above), take a photo and have the translation of your passport certified.
  2. Pay the state fee of 5 thousand rubles in advance and keep the receipt.
  3. Send the documents by registered mail to the Main Migration Department of the Ministry of Internal Affairs, where the residence permit was issued.
  4. Next, you will be contacted and informed when you need to pick up the completed paper sample residence permit.

Please note that given the work of the Russian Post, the deadline for renewing the document may be delayed. You will also have to call and check whether the documents have arrived and what number your application is registered under (see sample above). Cost and payment procedure

The cost of a residence permit consists of the amount of the state duty. In 2021 it is 5 thousand rubles. Notarization of a passport translation will cost from 900-1 thousand rubles. Payment must be made according to the details indicated on the website of the Main Directorate for Migration of the Ministry of Internal Affairs of Russia.

Terms of service provision

The residence permit is renewed in 7-15 days. When submitting the package, you will be given a certificate of acceptance, which will indicate the date. Count down 60 days and expect to receive a new residence permit within this time frame.

“At the exit” the foreigner receives an indefinite residence permit, which does not need to be renewed after 5 years. Such a document gives the right to long-term residence in the Russian Federation, work, open a business, receive a pension upon reaching retirement age, as well as many other benefits available to Russians.

A residence permit actually differs from citizenship only in the inability to vote in elections or participate in the electoral process, as well as the ban on military service, receiving maternity capital, preferential family, and military mortgages.

You only need to notify the Ministry of Internal Affairs annually about your work and place of residence (you can do this by mail). We are talking about sending a completed notification form (download a sample here). Once every five years, this document is entered in person and not sent by mail.

Validity periods

The residence permit has no expiration date. If you decide to apply for citizenship, you will receive a Russian passport instead. But the Main Directorate for Migration Affairs of the Ministry of Internal Affairs has the right to cancel a residence permit in case of violations of the migration regime committed by a foreigner (for example, staying outside Russia for more than 6 months a year).

Therefore, it is still premature to say that a residence permit is issued forever. Practice shows that this document can easily be lost without notifying the Ministry of Internal Affairs every year and allowing other violations.

Extension and replacement of residence permit

For most foreigners, a residence permit is just a transitional stage on the path to citizenship. But there are people who have no plans to change citizenship, and they work in the country. It is this category – highly qualified specialists who apply to the authorized body for a residence permit extension.

Extension of the document is possible for the period for which the employer received permission and they entered into an employment contract.

Replacement of a residence permit is possible if the full name, gender, errors or inaccuracies in the records are changed, or the citizen reaches the age of 14, 20, or 45 years.

In 2021, the use of electronic information media in relation to the owner of a residence permit was approved.

Procedure for replacement and renewal:

  • Prepare all necessary documents.
  • Pay a fee in the amount of 5,000 rubles.
  • Apply for an extension.
  • Take a personal photo and submit your fingerprints.
  • Provide a copy of the employment contract.
  • Wait for notification of the decision.
  • Check to see if there is a mark on the renewal document.

Documentation

  • One copy of the application (fill out according to the sample). Write legibly, without erasures, corrections, etc.
  • Applicant's passport.
  • Valid residence permit.
  • Receipt confirming payment of the fee.
  • Certificate of proficiency in Russian, if it has not been issued before.
  • Four photos 3.5 by 4.5 cm that meet the requirements.

Sometimes additional documents are required:

  • Proof of income.
  • Confirmation of the right to own property in Russia.
  • A contract concluded with the employer, which describes the terms of cooperation and wages.

In this case, the foreign citizen must first receive an identification document (national passport of a citizen of a foreign state) with new personal data, and then, no later than ten days, apply for a replacement residence permit.

In any case, an application to replace the residence permit of a stateless person must be submitted no later than one month from the date of occurrence of any of the above circumstances.

Thus, at present there is no such legal concept as extension of a residence permit, but the range of circumstances under which the residence permit must be replaced has been significantly expanded.

In addition, a foreign citizen, during the validity period of his residence permit, issued before November 1, 2021 (i.e., with a five-year validity period), has the right to apply for a residence permit without limitation of validity (more details We will talk about this later in this article).

In accordance with the procedure in force from November 1, 2021, the period during which it is necessary to apply for a replacement residence permit is regulated differently in relation to foreign citizens and in relation to stateless persons.

A foreign citizen must submit an application to replace a residence permit in Russia no later than one month from the date:

It is more reliable in the department, because there you can get advice on the rules for filling it out.

If you are filling out the form at home and something is unclear, it is better not to write anything or do it in pencil so that you can enter the correct option later.

Data to be entered:

  • Full name, as well as information about changing the surname.
  • Date of Birth.
  • Data from a passport or other document used as an identification document for renewing a residence permit.
  • Information about citizenship and its change, if such a case occurred.
  • Information about marital status and children/incapacitated citizens.
  • Information about employment and wages.
  • Information about place of residence.
  • Information about criminal records, including in other countries.

You cannot submit an application that does not contain the signature of the applicant. The signature must be his or his representative.

What happens if you don't renew on time?

A foreigner will face an administrative fine of 2 to 7 thousand rubles for overdue documents. The most serious sanctions await in Moscow and St. Petersburg (from 5 to 7 thousand rubles).

If the period of residence in Russia without a residence permit is long or there have been other violations, they may be deported from the country. Returning under such circumstances and restoring the residence will be quite problematic.

If you are late in submitting your documents, you may be required to retake the Russian language exam if you are not a native speaker or a resident of Belarus or Turkmenistan.

If your residence permit is expired, you will have to:

  • leave the Russian Federation and return again;
  • receive a temporary residence permit (if you do not belong to a preferential category of citizens);
  • re-form a package of documents and go through the procedure for obtaining a permanent residence permit.

New registration of a residence permit requires larger expenses. For example, a new type of certificate of absence of infections, taking into account a coronavirus test, already costs at least 4.5 thousand rubles, although previously this amount was at the level of 3.5 thousand rubles.

Passing the test for knowledge of the Russian language and history will also cost at least 5 thousand rubles. Add to these amounts the state duty of 5 thousand rubles. If the renewal deadlines are met, all expenses of the foreigner may be limited to the amount of the state duty and payment for notary services (for certification of the translation of the passport).

A foreigner must leave Russia within 15 days if his residence permit has expired and he has not received an unlimited document. Otherwise, he may be fined and deported.
