Form and content

Every citizen of the Russian Federation has the right to move freely around the country and stay anywhere as long as needed. When living in one place for a long time, a person must be formally attached to it - that is, registered. If it is impossible to obtain permanent registration, the citizen must obtain a certificate of registration at the place of residence.

What's happened

Place of residence is the place of permanent residence of a person. He is tied to it with the help of permanent registration (in simple terms, “registration”), and his passport has a corresponding stamp.

If a person leaves home for a long time and lives in another place, then it is considered the place of his temporary stay.

If this lasts more than 90 days, then the citizen is obliged to declare himself to the migration service and issue a certificate of temporary registration.

Unlike permanent registration, when a stamp is placed in the passport, with temporary registration the applicant is issued a standard certificate, which is called Form 3 and is a separate document.

Temporary registration looks like a regular certificate - A5 paper, in which the necessary data has been entered and stamped by the service that issued it.

It is most reliable to store it together with your passport as an insert.

What is it for?

As a rule, the following citizens need temporary registration:

  • Foreigners;
  • stateless people;
  • citizens of the Russian Federation who moved to another region for a long time.

This document allows a person to live in a particular region legally and on an equal basis with its permanent residents. Also, having a certificate opens up a lot of familiar opportunities for a citizen.

Peculiarities

When a temporary registration is issued, the permanent one does not lose its validity - it just does not apply in another region.

The owner cannot interfere with obtaining a certificate, since he is responsible for concluding an agreement with persons who do not have registration.

The owner's permission is not required to move children into the apartment.

A minor child must be registered at the place of residence of the parent.

Obtaining a certificate is simple and the process does not take much time.

To do this you need to contact:

  • the nearest MFC;
  • FMS;
  • Passport Office;
  • Migration Service under the Ministry of Internal Affairs;
  • registration department at the HOA.

Validity

Can they refuse?

Most citizens receive a registration certificate without any problems - it is in the interests of the department to facilitate its registration, and not to hinder it. However, there are several reasons why a certificate may be refused.

Among them are the following:

  • the applicant did not provide all documents;
  • any of the documents turned out to be invalid;
  • the application was filled out incorrectly;
  • the premises are not intended for living;
  • the premises were seized.

Conditions for receiving the document

The law provides conditions that must be met by a person interested in obtaining a temporary registration certificate. First of all, a person must collect the documents necessary for registration. Then the interested person contacts the territorial department of the Ministry of Internal Affairs, which carries out registration at the place of temporary location. After receiving the necessary documents, the person will receive a certificate of registration at the address of residence.

Owner's consent

One of the mandatory conditions for issuing a certificate is the consent of the owner.

This rule is applicable in cases where a person intends to register in a private household or apartment, that is, owned by an individual.

The legislation does not define the procedure for obtaining permission. An issue of this nature is resolved through negotiations. It should be noted that consent can only be obtained with the voluntary expression of the will of the owner. No one can oblige the owner to register a person in his home. The exception in this case is the decision of the court. This is typical for cases where a person’s rights to residence have been violated and resettlement occurs forcibly. Also, the consent of the owner is not required if persons who have not reached the age of majority are registered in the premises where their parents or persons replacing them live.

The form of the document itself is not approved by current legislation. It is compiled in no particular order.

The text of the document reflects the following:

  • passport or birth certificate (for a child under 14 years old);
  • document on the basis of which registration is carried out (notarized lease agreement, Certificate of ownership).

For how long is it issued?


The minimum period for which the Certificate is issued is 3 months.
If registration is made on the basis of a rental agreement, then registration is carried out for the duration of its validity.

The maximum period for citizens of the Russian Federation is 5 years, for foreigners - 1 year.

At the end of the period specified in the document, it becomes invalid. any action to cancel the document. If you don't need the Certificate, you can simply not use it.
