Do all foreigners have to register?

If you are planning to visit Russia in the near future, start collecting what you will need for temporary registration in the country where you plan to spend some time.

All foreign citizens without exception are required to register. It does not matter whether they crossed the border on a visa or a passport. The purpose of your visit is also not important. Registration at your place of stay or place of residence is not required only if you plan to leave the state within 7 days. If you get it done in a week, you don’t need to submit the package of documents anywhere. By law, foreigners are allowed not to register during this period. If the period is longer, obtain all the necessary documents.

Those arriving from the Republic of Belarus, as well as Kyrgyzstan, Kazakhstan, Armenia and Tajikistan have a little more time. People from the first four countries can register within 30 days. As for Tajiks, they need to declare their arrival within 15 days.

Migration registration deadline

As a general rule (we do not take into account registration at the place of stay in hotels, special institutions, etc.), a foreign citizen is required to complete migration registration within 7 working days from the date of entry into the Russian Federation.

The following have the right NOT to register:

  • Highly qualified specialists (HQS) – within 90 days from the date of entry into the Russian Federation.
  • Citizens of Belarus and Ukraine - within 90 days from the date of entry.
  • Citizens of Armenia, Kazakhstan, Kyrgyzstan - within 30 days from the date of entry.
  • Citizens of Tajikistan - within 15 days from the date of entry.

It is important to note that if a foreign citizen plans to apply for a temporary residence permit or temporary residence permit, then, regardless of his status or citizenship, at the time of submitting the documents, he must have a valid migration record.

For citizens with visa-free entry, migration registration is issued for a period of 90 days from the date of entry into the Russian Federation. For visa citizens – for the duration of the visa.

What documents need to be submitted to the migration service?

The required list of documents is formed from two parts:

  1. Papers provided by the foreigner.
  2. What the host serves.

The contents of the package depend on whether you arrive with or without a visa, as well as who will handle your registration.

The foreigner is required to:

  1. Foreign passport and its photocopy.

Who can act as a party receiving a guest?

According to the legislation of the Russian Federation, current for 2021, temporary registration of foreign citizens is permissible provided that the latter stay with someone they know, rent an apartment or a hotel room. It is necessary to ensure a connection to a specific place.

Receivers can be:

  • Bodies that are part of the state government of the country.
  • International organizations, as well as representative offices operating on their behalf, located on the territory of the Russian Federation.
  • Domestic legal entities. These may be their individual representative offices, branches located in different regions, or the companies themselves.
  • A foreign citizen with the status of a high-qualified specialist who has his own housing in the Russian Federation. This category of persons has the right to register for temporary residence and for close relatives (members of their family).
  • A foreigner who owns residential space in Russia. In this case, the guest does not have the right to register other guests of the state, including immediate relatives.
  • Citizens of other countries who have received a residence permit and completed the registration process.
  • Citizens of the Russian Federation who are registered at their place of residence or have their own living spaces, for which registration of foreigners will be issued.

The required list of documents depends on who will register you, an employer, a relative or yourself.

If you are invited to Russia by an employer

To register foreign citizens who arrived for employment at the invitation of a legal entity, the following documents (copies) are required:

  • Certificate according to which the enterprise is registered as a legal entity.
  • TIN.
  • A contract concluded with a foreign citizen regarding the performance of labor activities.
  • Certificate of ownership or lease.
  • Company contact details, address, etc.

In addition to the listed copies, you must provide an extract from the Unified State Register of Legal Entities in the original. This document must be dated no later than 2 months.

A legal entity has the right to register foreigners only when registering with the migration service (GUVM MIA). Only accredited companies have the right to hire citizens from other countries.

If you are received by an individual

Most foreigners register in residential areas owned by Russian citizens. Accordingly, the latter collect the necessary papers and send them to the Department of Internal Affairs of the Ministry of Internal Affairs.

The following documents are provided:

  • Passport. This must be a document of a citizen, Russian or foreigner permanently residing in the country.
  • A copy of the above document.
  • Certificate of registration of the residential area where the foreigner will be temporarily registered (copy).
  • Arrival notification.

The main document of the list is a notification that must be completed. To enter the necessary information into its columns, you should use all the papers listed above.

What is the registration form

A foreign guest or those who receive him need to take care of correctly filling out a special notification of the arrival of a foreign citizen.

According to the order of the Ministry of Internal Affairs of Russia N856, which came into force on February 23, 2021, and approved on December 10, 2020, the regulations for the provision of public services for the implementation of migration registration of foreign citizens and stateless persons on the territory of the Russian Federation were updated.

As of February 23, 2021, new forms of arrival and departure notification forms have been introduced.

This is a mandatory standard form, relevant for all Russian regions. As a rule, the information is entered into it by the person who registers a guest from abroad.

There are requirements that must be met when filling out this document:

  1. Avoidance of blots, errors and corrections.
  2. Only reliable information corresponding to copies of the attached documents.
  3. There is a rectangular box for each letter.
  4. The filling language is Russian.
  5. You can only write in dark blue or black ink.
  6. Handwriting must be legible.
  7. Only capital block letters (samples are provided on the form).

After filling out the form, you must check each item. If the document does not meet the requirements, it will not be accepted.

The completed notification is the main document for submission to the migration service, accompanying all copies and originals attached to it.

After the guest or those who receive him submit a package of documents, employees of the Department of Internal Affairs of the Ministry of Internal Affairs verify the data, check the copies and the registration form, and then make a decision.

If everything is filled out correctly and there are no other grounds for refusal, the foreigner is allowed to stay on the territory of the Russian Federation for 90 days (note: not from the moment of registration, but from the moment of entry into the territory of the Russian Federation). After this period expires, he must leave the country or submit documents to renew his registration. There must be reasons for such a step.

Employees of the Ministry of Internal Affairs enter data about the foreigner into the database. The notification itself is torn into two parts, one of which is returned to the receiving person with a note that the notification has been accepted.

The detachable part of the notification with the seal of the Department of Internal Affairs of the Ministry of Internal Affairs is the document that indicates the legal stay of a foreign citizen on the territory of the Russian Federation.

Citizens of the following countries may initially request registration for up to a year:

  1. The Republic of Belarus;
  2. Armenia;
  3. Kyrgyzstan;
  4. Kazakhstan.

The basis for this will be an employment contract concluded with a Russian legal entity. Citizens of other countries, in order to remain in the Russian Federation after the expiration of the registration period, must apply for its extension. Otherwise, they will become illegal immigrants and will be deported to their homeland.

How to register at your place of stay: step-by-step instructions

The responsibility for registering for migration lies with the receiving party. If a foreigner comes to visit relatives, registration is carried out at the place of residence. If a migrant rents housing, he must inform the landlord about his legal status and agree with him on registration.

Now let’s consider the countdown of the deadline for registration with migration authorities. When crossing the Russian border, all migrants fill out migration cards, which indicate the date and time - these are the ones you need to focus on. The stay in the Russian Federation on the basis of a migration card is limited not to 30, but to 90 days, after which the foreigner must leave Russia if he did not have time to apply for a temporary residence permit.

The step-by-step registration algorithm at the place of stay looks like this:

  1. An Armenian citizen comes to the Russian Federation, finds housing here and negotiates registration with the owner.
  2. The owner of the property at the migrant’s residence address takes his documents and sends them to the migration department.
  3. The receiving party fills out a notification of the migrant’s arrival at the place of stay and submits other documents.
  4. The submitted documents are reviewed by employees of the Department of Internal Affairs of the Ministry of Internal Affairs from several minutes to 1-2 days, after which the applicant is given a detachable part of the notification, which will indicate the registration period, residential address and personal data of the migrant.

Example No. 1: registration for a citizen of Armenia

The man lives in Yerevan, but plans to move to Russia for further employment. To do this, he previously agreed with a potential employer about an interview, and a few days later he was already in Moscow. The arrival took place on March 20, 2018, therefore, he may not register until April 20, 2018, however, if he does not have a tear-off counterfoil, he may be expelled from the country.

Documents for registration were submitted by the migrant’s landlord on March 23, 2018, i.e. just 3 days after arrival. On the same day, the foreigner received a detachable notification confirming his registration at the place of residence, and he was able to continue to apply for a temporary residence permit and look for work.

Note! As stated earlier, a notarized copy of the foreign citizen’s passport is provided to the migration department. He must receive it himself - this is not the responsibility of the receiving party.

Registration Features

The procedure for migration registration and stay of foreign citizens has a number of features that need to be taken into account:

  • If a migrant comes to the Russian Federation for employment, the period of temporary registration is extended for the duration of the employment contract. However, the extension does not occur automatically: in any case, you will have to contact the Department of Internal Affairs of the Ministry of Internal Affairs again.
  • A foreigner is required to find a job in Russia within 90 days, otherwise he will have to pay a rather large fine - up to 5,000 rubles, and for large cities such as Moscow and St. Petersburg it increases to 7,000 rubles. Employment is necessary to stay in the Russian Federation legally after registration is completed.
  • The basis for extending the period of stay is not only employment, but also registration of a temporary residence permit.

A migrant may be denied migration registration if an incomplete package of documents is provided or the notification is filled out incorrectly. To prevent this from happening, it is better to immediately seek help from lawyers: they know exactly what needs to be done to ensure that everything is processed correctly and without problems.

Features of registering minors

If children arrive in Russia with a foreign citizen, they must also obtain temporary registration in the country. The procedure is the same as when registering an adult: documents are collected and sent to the migration service.

In most cases, the receiving party is required to notify the child of his arrival in the country within 7 days. However, for some countries the law provides for different deadlines. Thus, citizens of Tajikistan have up to 15 days to register minors; for Kyrgyz, Belarusians, Kazakhs and Armenians this period is 30 days. As for residents of neighboring Ukraine, including the Donetsk and Lugansk regions, they must register their children, as required in most cases, within 7 days.

To obtain temporary registration for minors, the party receiving the minor must provide the following documents to the Main Directorate for Migration:

  • A migration card issued for a child when crossing the border.
  • If a minor foreigner is under 14 years of age, his birth certificate must be presented. Upon reaching 14 years of age, you must provide a foreign passport.
  • VHI policy.

  • Ownership of the living space where a minor guest from another country will be registered.

If parents ignored the rules and did not register their child, they will have to pay a fine for the violation as punishment.

The responsibility for registering foreign citizens in the Russian Federation for migration lies with the receiving party.

The receiving party means:

  • foreign citizen or stateless person who permanently reside in the Russian Federation
  • legal entity, branch or representative office of a legal entity
  • federal government body, government body of a constituent entity of the Russian Federation, local government body, diplomatic mission, or consular office of a foreign state in the Russian Federation

A foreign citizen or a stateless person who is a highly qualified specialist and owns residential premises on the territory of the Russian Federation can also act as a host in relation to his family members.

Important! For violations in the field of migration registration of foreign citizens in the Russian Federation, serious administrative liability is provided for both the foreign citizen and the receiving party.

A foreign citizen may be fined in the amount of 5,000 to 7,000 rubles and subject to administrative expulsion from the territory of the Russian Federation (the basis for a further ban on entry into the Russian Federation). The receiving party is an individual, may be fined in the amount of 2,000 to 4,000 rubles, an official - from 40,000 to 50,000 rubles, a legal entity - from 400,000 to 500,000 rubles. There is criminal liability for fictitious migration registration of foreign citizens!

The procedure for registering for migration

Registration for migration occurs by sending the receiving party a notification in an approved form to the district migration office at the address of the residential/non-residential premises or office address.

To fill out the notification, you need a migration card (document about crossing the Russian border), a copy of the passport and visa (if the foreigner arrived from a “visa” country) of the foreign citizen.

Based on these documents, the receiving party fills out a notification and submits it to the regional Department of Internal Affairs of the Department of Internal Affairs of Russia. The notification can be submitted directly to the Department of Internal Affairs of the Department of Internal Affairs, or sent by a valuable letter with a list of attachments by Russian Post, or submitted through the Multifunctional State Services Center (MFC). Extension of migration registration for foreign citizens from countries with a visa-free regime is carried out on the basis of a patent, for citizens from the EAEU (Belarus, Kazakhstan, Armenia, Kyrgyzstan) on the basis of an employment contract.

Important! For foreign citizens from countries with a visa-free entry regime, you must register at your actual place of stay. If, when applying for a patent, the migration department employees do not see the registration in the OBM database, the patent will be refused.

If a refusal is issued, it will be possible to reapply for a patent only after 1 year.

If a foreign citizen is detained by OMVD officers with an expired or false registration, he will face a fine and, most likely, administrative expulsion from the territory of Russia.

Important! In July 2021, changes occurred in the rules for registering for migration. A foreign citizen can be registered for migration only at the place of actual residence . The changes are designed to stop fictitious registration of foreign citizens.

The owner of the premises must personally submit a notice of registration in a residential premises. For this purpose, a certificate of ownership of the premises is provided.

Legal entities can register foreign citizens at their address only if the citizens actually live at this address or live in premises that do not have an addressable facility (cabins, construction trailers, etc.). To register, you must provide proof of availability of living conditions at the employer's premises.

Migration registration deadlines

For different categories of foreign citizens, there are different terms and conditions for registering foreign citizens at their place of stay.

For most foreign citizens, notification of arrival at the place of residence must be submitted no later than 7 days from the date of entry of the foreign citizen into Russia.

Registration at the place of residence of the HQS

Separately, it is worth highlighting the registration procedure at the place of residence for highly qualified specialists.

It has a slightly different procedure than other foreign citizens. HQSs and their accompanying family members are allowed to stay on the territory of Russia without registration for 90 days from the date of entry into the Russian Federation. After the expiration of the specified period, the foreigner must be registered at the place of stay within 7 days.

In practice, foreign highly qualified specialists are often on work trips and business trips and, as a result, do not register for migration for a long time.

A different procedure is provided for the registration of a foreign citizen at the place of residence who has a temporary residence permit or residence permit.

These categories of foreign citizens must be registered at their place of residence. A mark of registration at the place of residence is affixed to the passport or residence permit. In this regard, it is not necessary to send a registration notification to the migration authority every time within 7 days after entering the Russian Federation.

How to renew your registration

90 days is the period that you can stay in Russia for six months. In the next six months you can come again and start a new countdown. Many find it inconvenient to travel from state to state, so they contact migration services to obtain information about what is required to renew the registration of a foreign citizen.

The following circumstances can be taken as grounds:

  • The foreigner was officially recognized as a refugee in the Russian Federation.
  • Obtaining a patent.
  • Obtaining or extending a permit to perform labor activities in the Russian Federation.
  • The employment contract with VKS was extended.
  • Obtaining citizenship of the Russian Federation by a foreigner.
  • We accepted a foreigner’s application for a residence permit or temporary residence permit.
  • Availability of RVP.
  • Obtaining a residence permit.
  • The Russian Federation guest visa has been extended.

There may be other situations in which a person cannot leave the state on time. Circumstances such as the death of a loved one, a serious illness of the foreigner himself or the need for urgent medical care on Russian territory are always taken into account by migration services. The main thing is that the reason for applying for an extension is documented. In this case, as always, we are talking about documents that will become the basis for re-registration.

An application for renewal of registration is submitted in any form

The following documents are provided to the Main Migration Department of the Ministry of Internal Affairs:

  1. A copy of the migration card received upon arrival.
  2. A copy of the international passport of the person intending to renew the registration.
  3. Petition. There is no special form provided. The document is drawn up in free form. The main thing is to clearly state the essence of your request.
  4. Papers that are official confirmation of the existence of a reason for renewing registration in the Russian Federation.

An application for renewal of a migration card can be submitted either by the foreigner himself or by the receiving party. It is important to contact the migration service no later than a week (7 days) before the expiration of the previous registration. It is advisable to apply 2 weeks in advance. As with the initial registration, employees of the Ministry of Internal Affairs carefully check everything and invite the applicant to appear to receive approval or refusal, depending on the circumstances. It takes a week to make a decision.

The registrations of minor citizens are extended based on the extension of the temporary registration of their parents. For example, if a parent has received a patent, which for him is the basis for filing an application (for a child, a patent is not such), the child’s registration will be extended, since the parent’s period of stay in the Russian Federation will increase.

Extension of migration registration

According to the law, only those foreign citizens who have grounds for extending their stay in the Russian Federation have the right to extend their migration registration. Thus, migration registration can be extended only if:

  • submitting documents for a temporary residence permit (only for citizens with visa-free entry)
  • submitting documents for residence permit
  • submitting documents to obtain HQS status
  • visa extension (in most cases we are talking about a work visa)
  • obtaining a work permit
  • obtaining a patent
  • admission to study at a Russian university
  • concluding an employment contract (for citizens of Belarus, Armenia, Kazakhstan, Kyrgyzstan)
  • citizens of the LPR and DPR
