Migration amnesty 2021

The amnesty for violators of the rules of stay in the Russian Federation in 2021 is of a one-time nature. The event is not based on any legal norms, but is held solely thanks to the agreements of the presidents of friendly countries. A distinctive feature of this year’s amnesty is that it addresses the violations described in Article 27 of the Federal Law on the procedure for entry and exit into the Russian Federation.

First of all, the amnesty applies to foreign citizens with passports of the following countries:

  • Tajikistan;
  • Kyrgyzstan;
  • Moldova.

Tajikistan

The State Duma and the government of Tajikistan, led by President Emomali Rahmon, are actively discussing the possibility of introducing the next stage of amnesty. The amnesty will likely affect several categories of citizens of Tajikistan, including:

Important! Thanks to the amnesty, all citizens of Tajikistan who have an expired migration card or other violations have the right to directly contact the Main Migration Department of the Ministry of Internal Affairs. If the governments successfully agree on a new wave of migration amnesty for offenses, residents of Tajikistan will have the right to reset their stay in the Russian Federation according to the following scheme:

Kyrgyzstan

Kyrgyz who violated the rules of stay in the Russian Federation were given the opportunity to reset all migration offenses. In order to begin their stay in the Russian Federation legally, persons must:

  • travel outside the country;
  • drive back;
  • pay a fine for violations;
  • register with the migration service;
  • comply with all rules for staying in Russia in the future.

Note! Citizens of Kyrgyzstan who are on the blacklist also receive the right to take advantage of the amnesty and regain their right to enter the Russian Federation.

According to statistics, over 600 thousand labor migrants from Kyrgyzstan work in Russia. Such a large number of migrants is due to the republic’s entry into the EurAsEC.

Every year, Kyrgyz passport holders send about two billion US dollars home, which is comparable to the size of the entire budget of the Asian state. Moldova

The governments of the Russian Federation and Moldova are actively cooperating, as evidenced by the emergence of the second major phase of amnesty for Moldovans staying in Russia illegally.

The main disadvantages of forgiveness of migration violations among Moldovan citizens in 2021 were:

  • lack of advance warning about the start of the promotion;

  • resettlement of Compatriots;
  • relocation of highly qualified specialists;
  • relocation of native Russian speakers.

DPR and LPR

At the end of 2021, a bill on migration amnesty for residents of the LPR and DPR was submitted to the State Duma. However, at the moment this law has not been considered.

However, on April 24, 2021, Russian President Vladimir Putin signed a decree on the simplified issuance of passports to all residents of the Lugansk and Donetsk regions that are part of the unrecognized republics.

Uzbekistan

Legal basis

The regulations of Chapter 26 of the Federal Law “On the Procedure for Exit and Entry into the Russian Federation” regulate issues regarding the preparation and issuance of documents allowing foreign citizens and stateless persons to enter the territory of the Russian Federation, move freely within it and leave it after some time. It notes that a citizen of a foreign state can cross the Russian border with valid documents identifying him. But he must indicate the period of stay in the country in accordance with the requirements of international law.

Essentially, a “visa” is an official permit that allows any foreign citizen to enter another state legally. Its form, procedure and conditions for registration, issuance and cancellation are established by the Government of the Russian Federation in accordance with the norms of Federal Act No. 114-FZ. The visa contains the following information about the foreign citizen regarding:

  • personal data;
  • citizenship;
  • residence permit;
  • dates of birth;

Who is eligible for amnesty?

The list of persons covered by the amnesty depends on the country from which they arrived in the Russian Federation:

The legislator introduced a procedure for closing entry in order to regulate legal relations in the field of migration of the population of neighboring countries to the Russian Federation.

It is a new legal instrument that allows the state migration policy to be carried out at the proper level. Its main goal is to improve the regulatory framework in order to properly implement the tasks of combating illegal migration.

Reasons for applying the procedure

The list of government bodies authorized to make decisions on imposing a ban on the entry of foreign citizens into the Russian Federation was approved by a resolution of the Government of the Russian Federation. Who does it apply to?

In accordance with the norms of legislative acts, an entry ban is imposed for various reasons. Citizens of foreign countries are deprived of entry rights if they:

As the grounds for deprivation of the right to enter are eliminated, the foreign citizen will be allowed to enter the country without any restrictions.

In some cases, he is allowed to visit her after the expiration of the ban established by the legislator. The standard is intended to be applied if a citizen of another state has committed a criminal act on the territory of his country or the Russian state.

Who is not eligible for amnesty?

The categories of foreign citizens listed below do not receive the right to a migration amnesty:

  • who provided knowingly false information when crossing the border;
  • members of terrorist or extremist organizations;
  • posing a threat to Russia's national security;
  • deported or expelled from the country by a court decision;
  • having an outstanding criminal record;
  • having unpaid taxes, fees or government duties;
  • having several fines for violating immigration laws.

Important! Citizens who owe taxes or government duties do not need amnesty. To obtain the right to enter the Russian Federation, they only need to pay off all debts and wait one month.

The most serious is a violation under Article 27 Part 1, Paragraph 1 on the threat to the security of Russia.
