The policy of simplifying the rules of stay in the country has long been practiced by the Russian government. In order to improve relations with neighboring countries, the government regularly implements one-time promotions, within which holders of foreign passports have the opportunity to clear all violations of the rules of stay in the Russian Federation and register in the country legally. The next migration amnesty for citizens of Kyrgyzstan, Moldova, Tajikistan and other neighboring countries will be implemented in 2019.

Migration amnesty 2021
The amnesty for violators of the rules of stay in the Russian Federation in 2021 is of a one-time nature. The event is not based on any legal norms, but is held solely thanks to the agreements of the presidents of friendly countries. A distinctive feature of this year’s amnesty is that it addresses the violations described in Article 27 of the Federal Law on the procedure for entry and exit into the Russian Federation.
First of all, the amnesty applies to foreign citizens with passports of the following countries:
- Tajikistan;
- Kyrgyzstan;
- Moldova.
At the same time, residents of the LPR and DPR republics and countries such as Ukraine, Uzbekistan, Kazakhstan are not covered by this one-time promotion.
Tajikistan
The State Duma and the government of Tajikistan, led by President Emomali Rahmon, are actively discussing the possibility of introducing the next stage of amnesty. During the negotiations, the parties discuss the conditions for granting “forgiveness” for violators and the duration of such an action.
The amnesty will likely affect several categories of citizens of Tajikistan, including:
- Persons who entered the Russian Federation and did not leave its territory on time. Such migrants, as a rule, have overstayed their entry and violated the regime of stay in Russia.
- Persons who have an entry ban due to two violations.
- Persons who have an entry ban due to violation of the rules of stay in the country.
Important! Thanks to the amnesty, all citizens of Tajikistan who have an expired migration card or other violations have the right to directly contact the Main Migration Department of the Ministry of Internal Affairs. The government agency undertakes not to impose administrative sanctions or expel violators from the country.
If the governments successfully agree on a new wave of migration amnesty for offenses, residents of Tajikistan will have the right to reset their stay in the Russian Federation according to the following scheme:
- registration of a new migration card;
- registration;
- registration of a patent for employment.
Important! After issuing a new migration card, foreign citizens from Tajikistan have the opportunity to legally stay in Russia for 90 days.
Kyrgyzstan
Kyrgyz who violated the rules of stay in the Russian Federation were given the opportunity to reset all migration offenses. In order to begin their stay in the Russian Federation legally, persons must:
- travel outside the country;
- drive back;
- pay a fine for violations;
- register with the migration service;
- comply with all rules for staying in Russia in the future.
Note! Citizens of Kyrgyzstan who are on the blacklist also receive the right to take advantage of the amnesty and regain their right to enter the Russian Federation.
According to statistics, over 600 thousand labor migrants from Kyrgyzstan work in Russia. Such a large number of migrants is due to the republic’s entry into the EurAsEC.
Every year, Kyrgyz passport holders send about two billion US dollars home, which is comparable to the size of the entire budget of the Asian state. Unfortunately, the lion's share of migrants are in Russia illegally and risk being blacklisted. It is these migrant workers who count on regular migration pardons from the Russian authorities.
Moldova
The governments of the Russian Federation and Moldova are actively cooperating, as evidenced by the emergence of the second major phase of amnesty for Moldovans staying in Russia illegally.
The main disadvantages of forgiveness of migration violations among Moldovan citizens in 2021 were:
- lack of advance warning about the start of the promotion;
- lack of full coverage of the procedure in the media and on the official Internet portals of the Ministry of Internal Affairs;
- inaccurate description of the list of citizens entitled to benefit from forgiveness of migration violations.
It is obvious that the governments of both countries have drawn conclusions and made appropriate amendments. Therefore, compared to last year’s event, amnesty 2021 has a number of significant advantages:
- Advance coverage of the event.
- A clear interpretation of the categories of violators who have the right to take advantage of this opportunity.
- A large number of offenses annulled as part of the procedure.
Important! Among the validity periods of the amnesty, 2 dates should be highlighted: January 1, 2021 – the possibility of leaving the Russian Federation without sanctions; February 25, 2019 – the possibility of entering Russia with previous violations reset.
Ukraine
The State Duma is actively discussing the possibility of introducing a migration amnesty for citizens of Ukraine. However, to date, no concrete steps have been taken.
If necessary, Ukrainians have the opportunity to use one of the active state programs of the Russian Federation to legalize their stay:
- resettlement of Compatriots;
- relocation of highly qualified specialists;
- relocation of native Russian speakers.
DPR and LPR
At the end of 2021, a bill on migration amnesty for residents of the LPR and DPR was submitted to the State Duma. However, at the moment this law has not been considered.
However, on April 24, 2021, Russian President Vladimir Putin signed a decree on the simplified issuance of passports to all residents of the Lugansk and Donetsk regions that are part of the unrecognized republics.
Uzbekistan
As of 2021, the number of workers from Uzbekistan in Russia exceeded 1.7 million. Guest workers annually transfer over 2.5 billion US dollars to their homeland. However, in 2019, the government of the Russian Federation does not plan to organize a migration amnesty for holders of Uzbek passports.
Kazakhstan
Due to the small number of Kazakh migrants in the Russian Federation, the issue of introducing a migration amnesty between the leaderships of these states has not been raised for many years.
General concepts
In fact, an amnesty for Tajiks is an excellent opportunity to legalize their legal status, which allows them to legally stay on the territory of the Russian Federation. In addition, they can take advantage of the lifting of the ban that prevents them from entering the country. But the amnesty is not available to everyone, but only to a certain category of Tajik citizens who meet certain criteria.
Legal basis
The regulations of Chapter 26 of the Federal Law “On the Procedure for Exit and Entry into the Russian Federation” regulate issues regarding the preparation and issuance of documents allowing foreign citizens and stateless persons to enter the territory of the Russian Federation, move freely within it and leave it after some time. The act was issued by the legislator under number 114-FZ.
It notes that a citizen of a foreign state can cross the Russian border with valid documents identifying him. But he must indicate the period of stay in the country in accordance with the requirements of international law.
Essentially, a “visa” is an official permit that allows any foreign citizen to enter another state legally. Its form, procedure and conditions for registration, issuance and cancellation are established by the Government of the Russian Federation in accordance with the norms of Federal Act No. 114-FZ. In addition, they provide for measures to extend its validity and restore it if it is lost for any reason.
The visa contains the following information about the foreign citizen regarding:
- personal data;
- citizenship;
- residence permit;
- dates of birth;
- gender;
- series and number of an identity document recognized in the Russian Federation with a photograph;
- visa issue dates;
- permitted period of stay in the country;
- visa validity period;
- purpose of the trip.
A visa is issued on a paid basis, for which a foreign citizen must pay a consular fee and a payment that reimburses actual expenses. Their size is established in accordance with the standards of current legislative acts of the Russian Federation.
Who is eligible for amnesty?
The list of persons covered by the amnesty depends on the country from which they arrived in the Russian Federation:
Citizenship of a foreigner | Which categories of citizens are affected? |
Kyrgyzstan | The amnesty applies to citizens:
The amnesty also affects the Kyrgyz who are on the blacklist. According to official data, as of the end of 2021, 65 thousand citizens of Kyrgyzstan are prohibited from entering Russia. |
Moldova | The action affects citizens who have violated:
|
Tajikistan | The following will be able to take advantage of the amnesty:
|
Important! If a migrant takes advantage of the amnesty and immediately commits a new administrative offense, this will negatively affect his history and lead to the imposition of various types of sanctions, including deportation from the country.
Law on amnesty for migrants from Tajikistan in 2021
Important!
The amnesty does not apply to citizens of Tajikistan who have been banned from entering the Russian Federation for other offenses (for example, a foreigner does not have the right to enter the Russian Federation if he has an unexpunged or unexpunged conviction for committing an intentional crime on the territory of the Russian Federation, etc.) . In other words, all Tajiks with an entry ban who could be covered by the 2021 amnesty have already been automatically allowed entry into the Russian Federation.
Ikhtiyor Abdullayev replaced Rustam Inoyatov as head of the NSS The President pointed out the need to restructure the NSS Rustam Inoyatov became State Advisor to the President and a member of the Senate Deputies prepared a request to the government about “Autotest” An earthquake was felt in Tashkent Search results for the phrase “Amnesty for migrants from Uzbekistan” More than 20 homeless people were delivered to medical institutions in Tashkent on January 30.
What is needed for this
To qualify for the amnesty, violators need only complete a simple list of actions:
- Travel outside the Russian Federation within the specified time frame. At the same time, the Ministry of Internal Affairs will not interfere with border crossing.
- Submit an application requesting the lifting of the ban on entry into the Russian Federation.
- Return to Russia.
- Pay an administrative fine for illegal stay in the country.
- Register with the Main Migration Department of the Ministry of Internal Affairs and fill out the migration form again.
- Do not violate immigration laws in the future.
Before taking advantage of the promotion, it is important for a foreigner to make sure that his offense falls under the amnesty. To do this, it is enough to study in detail the conditions for granting the amnesty or contact a professional lawyer.

Application of a ban on entry into the Russian Federation
The legislator introduced a procedure for closing entry in order to regulate legal relations in the field of migration of the population of neighboring countries to the Russian Federation.
It is a new legal instrument that allows the state migration policy to be carried out at the proper level. Its main goal is to improve the regulatory framework in order to properly implement the tasks of combating illegal migration.
Reasons for applying the procedure
The list of government bodies authorized to make decisions on imposing a ban on the entry of foreign citizens into the Russian Federation was approved by a resolution of the Government of the Russian Federation. The act “On the procedure for making a decision on not allowing a foreign citizen or stateless person to enter the Russian Federation” was issued by him on January 14, 2015, number 12.
His instructions are focused on improvement:
- legal regulation of combating illegal migration;
- rules on the extent of liability of foreign citizens for violation of the period of stay, rules of stay and residence on the territory of the Russian state;
- systems of state control over the behavior of foreign citizens who are in the country.
Who does it apply to?
In accordance with the norms of legislative acts, an entry ban is imposed for various reasons. Their expanded list is laid down in the regulations of Federal Law No. 114-FZ, Government Resolution No. 12. They provide for the procedure for applying the measure and explain the rules for lifting the ban.
Citizens of foreign countries are deprived of entry rights if they:
- violated the period of stay on the territory of the Russian Federation. The duration of the enforcement period is 3 years
if a citizen of another state stayed illegally in the country from one day to 90 calendar days.
In case of illegal stay for up to six months, the ban period is increased to 5 years
; if it reaches 270 days, the right to enter is deprived for 10 years; - were late in making the mandatory payment for receipt or paid tax using incorrect details. As practice shows, this type of offense is the most common;
- were subject to administrative sanctions more than 2 times for committing offenses, regardless of their severity. For example, they did not register temporarily at their place of residence in a timely manner. The possibility of imposing a ban on entry for drinking alcoholic beverages or smoking in public places or violating traffic rules cannot be ruled out;
- conveyed false information about themselves or the goals and objectives due to which a foreign citizen seeks to enter the territory of the Russian state;
- violated customs or sanitary rules when crossing the border of the Russian state.
As the grounds for deprivation of the right to enter are eliminated, the foreign citizen will be allowed to enter the country without any restrictions.
In some cases, he is allowed to visit her after the expiration of the ban established by the legislator. The standard is intended to be applied if a citizen of another state has committed a criminal act on the territory of his country or the Russian state.
In addition, he is deprived of the right to enter if he presents an incomplete package of documents required for a visa or submits false documents to the consulate. For example, documents of third parties that he deliberately used.
Who is not eligible for amnesty?
The categories of foreign citizens listed below do not receive the right to a migration amnesty:
- who provided knowingly false information when crossing the border;
- members of terrorist or extremist organizations;
- posing a threat to Russia's national security;
- deported or expelled from the country by a court decision;
- having an outstanding criminal record;
- having unpaid taxes, fees or government duties;
- having several fines for violating immigration laws.
Important! Citizens who owe taxes or government duties do not need amnesty. To obtain the right to enter the Russian Federation, they only need to pay off all debts and wait one month.
The most serious is a violation under Article 27 Part 1, Paragraph 1 on the threat to the security of Russia.
If the FSB, SVR and the Ministry of Defense establish that a migrant is involved in illegal actions and undermining national security, the latter is expelled from the country with a lifelong ban on re-entry.
At the same time, foreigners deported under this article will never be eligible for migration forgiveness.
Amnesty 2021 in Russia for administrative cases for citizens of Tajikistan 2021
Companions of the oppositionist spoke about the harsh rules in IK-2 of the city of Pokrov, Vladimir region, where Alexei Navalny will probably serve 2.5 years of his sentence. In the institution, prisoners are prohibited from communicating; their every action is monitored by the administration and the “activists” working for it.
He considers this amnesty, which was not enshrined in any legislative act, “a trap for migrants to bring them out of the shadows.” “How else can we explain the fact that the official document on the migration amnesty was not adopted? The employees of the Ministry of Internal Affairs themselves did not know the procedure and refused to do anything, since there was no official paper or order.
In summary: which foreigners are eligible for amnesty and what are the intricacies of the process?
Between the end of 2021 and the beginning of 2021, the Russian Federation announced forgiveness of migration violations for citizens of Moldova and Kyrgyzstan. In addition, this action is being actively discussed in relation to migrants with passports of Tajikistan.
Amnesty for violations of migration legislation is carried out only for certain categories of foreign citizens who have not committed serious crimes and are not members of terrorist organizations.
