A patent must be obtained by every foreign citizen who wishes to legally carry out labor activities in the territory of the Russian Federation. Registration of work activity and stay on the territory of Russia is a mandatory condition for citizens who wish to subsequently obtain a residence permit and obtain Russian citizenship.

Why and to whom is it needed?

Changes in the migration policy of the Russian Federation are associated with the foreign policy and internal situation of the economy, both global and Russian. In connection with this, changes in the procedure, list of documents and other aspects of legalization of work and residence for foreign citizens occur annually.

A patent is a document required for every foreigner arriving in Russia to work, in a visa-free regime from countries outside the customs union. A work patent will be required for citizens of Abkhazia, Azerbaijan, Uzbekistan and Ukraine. It doesn’t matter whether a Ukrainian plans to get a job officially under an agreement with a legal entity, or to work without an agreement, with an individual, to earn a legal income, it will be necessary to obtain a patent.

Features of the document

A patent is a document allowing a citizen to work in Russia. Before registering it, it’s worth understanding what rights it gives:

  1. The patent has a territorial reference. That is, a foreigner with a patent has the opportunity to work only in a certain territorial unit, which is included in the document. It is also worth keeping in mind the following fact: a patent for work in Moscow does not give a Ukrainian the right to work in the Moscow region. If you plan to work in Moscow and the Moscow region, then you will need to issue 2 patents. The same situation is in St. Petersburg;
  2. The patent specifies the type of activity. Since 2016, a specialty has been prescribed in the document, therefore, a Ukrainian who receives such a permit can carry out labor activities only by profession;
  3. The validity period of the document is from 1 month to a year. When applying for a patent, a Ukrainian will have to make an advance payment for the period of employment in the Russian Federation. The amount of patent tax depends on the region of registration. Funds must be paid on time, otherwise the patent will be revoked;

Thus, a patent is, in essence, a form of personal income tax for foreign citizens. A Ukrainian who wants to work legally in the Russian Federation will be required to apply for a patent.

Obtaining a patent in Moscow for Ukrainians

Moscow and the Moscow region account for the largest flow of migrants: both internal (Russians from other regions) and foreign. This is probably why the issuance of documents there is most efficient. To obtain a patent to work in Moscow, Ukrainians need to contact the IMC in Moscow.

Moreover, you can only come there with a passport, migration card and MU form. All other documents can be completed on the spot, but not free of course. They promise that the procedure will take no more than 2 hours. You will need to visit there a second time in 10 days to get a completed permit.

The cost of a monthly patent tax in Moscow is 5,341 rubles, and in the Moscow region - 5,092 rubles.

Patents issued by Moscow and the Moscow region do not indicate a profession, which significantly expands employment opportunities. However, when filling out the application, you must indicate your current specialty on the official form.

Please note: A work permit in Moscow is not suitable for employment in a company registered in the Moscow region. Exactly the other way around. If it happened that you worked in Moscow, and then quit and want to get a job in the region, then you will need to: a) register with the Moscow Region ; b) issue a new patent for MO . It is not prohibited. You simply do not renew the old patent and it is canceled on its own.

Registration cost

How much it will cost to obtain a patent for a citizen of Ukraine does not depend on the type of activity that he plans to conduct, and directly depends on the region of registration. The price of a patent can be calculated using the following formula:

Base rate * personal income tax deflator coefficient * regional coefficient = Monthly payment for a patent.

For example, let’s take the indicators for 2021 and calculate the cost of a patent in Moscow:

  • The personal income tax deflator coefficient for 2021 was 1.623;
  • The coefficient for the Moscow region was 2.1566;
  • Basic rate – 1200;
  • We get the calculation: 1.623*2.1566*1200=4200;
  • Thus, the cost of a monthly fee for a patent in Moscow for a citizen of Ukraine will be 4,200 rubles.

Preparatory procedures

In order to obtain a patent for work, a Ukrainian will need to submit a package of documents and an application for a permit to the Federal Migration Service of the Russian Federation, observing the deadlines for the procedure. The procedure, however, is very unique, and therefore deserves and requires not only detailed consideration, but also the completion of a number of preliminary procedures:

  1. When entering Russia, a citizen of Ukraine must have a foreign passport;
  2. Upon registration of entry, the Ukrainian will receive a migration card, which must indicate that the purpose of entry is work;
  3. On the day of entry, insurance is issued;
  4. Within 7 days, a citizen of Ukraine must register for migration at their place of residence or work. By the way, for citizens of Tajikistan, registration takes a longer period, namely 15 days;
  5. After this, you will be able to apply for a patent for your work within 30 days.

Registration of a patent for work

In accordance with Art. 13.3 of the Federal Law of the Russian Federation No. 115-FZ of July 25, 2002 “On the legal status of foreign citizens in the Russian Federation”, foreign citizens who arrived in the Russian Federation in a manner that does not require a visa, and who have reached the age of eighteen years, have the right to work for territory of the Russian Federation with a patent

Documents for obtaining a patent by a foreign citizen can be submitted to the Department of Internal Affairs of the Main Directorate of the Ministry of Internal Affairs of Russia for St. Petersburg and the Leningrad Region in person within 30 calendar days from the date of entry into the Russian Federation

without paying a fine for violating the deadline for applying for a patent.

A patent is issued to a foreign citizen for a period of one to twelve months. The validity period of a patent can be repeatedly extended for a period of one month. In this case, the total validity period of the patent, taking into account extensions, cannot be more than 12 months from the date of issue of the patent.

The validity period of a patent is considered extended for the period for which personal income tax is paid in the form of a fixed advance payment. In this case, contacting the territorial bodies of the federal executive body in the field of migration is not required.

Otherwise, the patent expires on the day following the last day of the period for which the personal income tax was paid in the form of a fixed advance payment.

  • passport of a foreign citizen (valid for at least 1 year);
  • migration card (original);
  • notification of migration registration (original);
  • TIN obtained in the Russian Federation (if available);
  • a document confirming knowledge of the Russian language, the history of Russia and the fundamentals of the legislation of the Russian Federation (if available): a state standard on education (at a level not lower than basic general education), issued by an educational institution on the territory of a state that was part of the USSR, before September 1, 1991;
  • on education and (or) qualifications issued to persons who have successfully passed the state final certification in Russia since September 1, 1991.

Where to get the document

The migration service handles the registration of patent permits, but the applicant also has alternative options where to apply for it.   1. Pass a medical examination;
  2. Pass an exam on knowledge of the Russian language, the history of Russia, and the legislation of the Russian Federation (taken in the form of testing);
  3. Apply for a VHI policy;
  4. Pay the personal income tax fee for the patent;
  5. Prepare a notarized translation of the passport;
  6. Go through the fingerprinting procedure (your fingerprints will be taken);
  7. Fill out a patent application;
  8. Take a photo.

Conditions for issuing a patent for Ukrainians

  • undergo a medical examination for migrants;

The cost of translation and certification of a passport in different regions of the Russian Federation is different, but varies on average from 900 to 1500 rubles.   • St. Petersburg - 3993 rubles;
  • Krasnodar region - 4344 rubles;
  • Perm region - 3700 rubles;
  • Yakutia - 9772 rubles;

You need to renew a patent—read: pay tax on it—on a monthly basis, otherwise it will be revoked.

A work patent for citizens of Ukraine allows you to carry out labor activities only in the territory of the region where it was received. The minimum validity period of a patent is 1 month, the maximum is 1 year. Then it can be renewed for another year. The number of re-registrations is not limited.

Despite the fact that when receiving a work patent, citizens of Ukraine do not provide any documents about their existing education, the profession itself is indicated in it. And a Ukrainian citizen can only work in the specified specialty. The rule does not apply to all regions of the Russian Federation.
