But if a foreigner intends to live in the Russian Federation in his own apartment, then he issues not temporary, but permanent registration. It is worth noting that without a temporary residence permit or temporary residence permit, a foreign citizen will not be able to obtain permanent registration.

A foreigner registers himself at the address where his living space is located. Although visitors from abroad may not live in their own apartments, the registration form must indicate the addresses of their location. Application procedure:

  3. A person is required to leave a photocopy of his passport at the Ministry of Internal Affairs. The state fee is charged for permanent registration of foreign citizens, its amount is 350 rubles; there is no fee for temporary registration at the place of stay.

Information from Federal Law No. 5242/1 dated May 25, 1993. with changes and additions for 2021. reveals the opportunity to obtain confirmation of your actual place of residence as soon as possible. This law contains a set of rules and recommendations required when applying for registration.

If a person changes his place of residence in another city for no more than one month, a temporary residence permit is not required. The law provides for the possibility of staying in a specific locality without notifying the migration authorities throughout the entire month.

Also controversial is staying in one place for 90 days. However, in this situation, registration of the actual place of residence is not necessary.

The main controversial issue is the provision of Federal Law No. 5242/1, which states that a person must register for migration within 90 days of staying in a new city. But if the subject does not expect to stay in the city longer than the agreed period, there is no need to notify the migration service.

If a subject has not received a registration within 90 days, a fine will be imposed on him. The fine ranges from 1,500 rubles. up to 5,000 rubles, depending on the region.

Thus, the minimum period for obtaining temporary registration is considered to be 1 year, and the maximum period of stay in one city according to a certificate of temporary registration is 5 years.

Reference! After the expiration of this period, it is necessary to re-register, that is, to extend the right of residence in a new place.

There are four options for performing this operation:

  1. With the help of the migration service (UVM UMVD). The personal presence of the applicant and the owner of the apartment is required. The re-registration time takes on average 3 days, after which a new certificate is issued.
  2. Via mail. Documents with an attached inventory must be sent by mail. The response will also be sent by mail to the address indicated on the sender's envelope. This method can slow down the registration process, taking no more than 7 days from the date of sending the envelope.

Temporary registration implies that a person does not have ownership rights to housing. In this case, a person moves into a rented premises, concluding a social tenancy or rental agreement. Accommodation is also possible on other grounds.

  • You can register not only in an apartment or private house, but also in a hotel, sanatorium and other similar establishments where a citizen plans to stay for more than three months in a row.
  • Below are instructions on how to renew your temporary registration:
  • As a rule, the process takes no more than three days, but the timing largely depends on the place where the papers are submitted (for example, when applying to a multifunctional center, the procedure is delayed by one or two days).

In some cases, the list of documents is much larger. To receive a certificate as early as possible, check with the employee what documents are required to be prepared in your situation.

Legal basis

The initial migration registration of visitors is carried out for a period of up to 3 months (it does not matter which country a particular foreigner is a citizen of). Carrying out such a procedure allows you to stay in the Russian Federation legally for the mentioned period.

When it expires, you need to:

  • Travel outside of Russia;
  • Extend your registration until the full expiration of the period specified in the legislation.

Such an action can only be carried out if there are grounds.

It is noteworthy that citizens of some countries can obtain initial registration for 1 year if they have an employment contract concluded with an employer located in the Russian Federation.

Failure to comply with the described formalities entails a fine in the amount of 2,000 to 7,000 rubles. and deportation with a ban on future border crossings.

Definition of the concept

Extension of temporary registration means an increase in the permitted period of stay at a specific address. For residents of the Russian Federation, this term does not have a defining meaning. Upon completion of the previous registration, they issue a new one according to the same rules. A different approach is taken for foreigners. Is it possible to extend the period of temporary registration? Yes, but you need good reasons for this (see below).

The issue is regulated by the following legal acts.

  • Decree No. 713 of 1995. Determines the procedure for registering Russian citizens. Establishes the grounds for termination of registration.

It is also worth noting Presidential Decree No. 699 of 2021, which determined that, if necessary, to extend temporary registration at the place of residence, the applicant must contact the Main Department of Migration of the Ministry of Internal Affairs. A different approach is taken for foreigners and local residents.

  • For citizens of the Russian Federation. The registration period is limited to the time specified in the premises rental agreement (other similar documents). If there is no corresponding certificate, the citizen independently determines the maximum accounting period when submitting an application. The above is established by paragraph 30 of Resolution No. 713.
  • For foreigners. The validity period of the temporary registration is equal to the validity period of the visa. If a person visited the state on a visa-free basis, he can stay here for 90 days every six months.

In both cases, registration is terminated automatically upon the occurrence of appropriate grounds: departure of a migrant from the country, expiration of registration for local citizens, etc. If necessary, you can apply for early termination.

As already stated, the procedure is different for locals and foreigners. In the first case, the issue is regulated by Resolution No. 713, in the second - by Federal Law No. 115. There are also nuances regarding minor children. How to renew registration?

Citizen of the Russian Federation

Registration is canceled upon expiration of the period specified in the application for registration. It is believed that at this moment a person returns home.

This means that his permanent registration becomes effective again. How to extend temporary registration for a citizen of the Russian Federation? The legislation does not provide for such a possibility.

After the old registration expires, a new one must be issued. The conditions are as follows.

  1. The application deadline is 90 days from the date of termination of the previous registration.
  2. Documents (see below) must be submitted to the Main Department of Migration Affairs of the Ministry of Internal Affairs (passport office) or to the MFC.
  3. Extension of temporary registration for a citizen of the Russian Federation takes 3 working days.

The issue is regulated by Federal Law No. 115. In particular, Article 5 of this document states that the period of stay of a person arriving from abroad is limited to the period of validity of the visa. If a migrant arrived on a visa-free basis, he has the right to stay in the state for no more than 90 days. A person can obtain a residence permit only for a specified period of time.

Extension of temporary registration for a foreign citizen is closely related to an increase in the period of stay in the state. That is, you can get a residence permit if you have permission to stay in Russia. Extension of the period of temporary stay of a foreign citizen is possible under the following conditions.

  1. Conclusion of an employment agreement.
  2. Registration of a patent.
  3. Admission to an educational institution.
  4. Obtaining refugee status.
  5. Issuance of residence permit.

All of the above reasons are grounds for renewing the registration of a foreign citizen. The extension of the period of registration is carried out automatically, since, on the basis of Article 23 of Federal Law No. 109, it terminates only upon the death of a person, leaving the country, registering in another place or leaving the previous home, or discovering the fact of fictitious registration.

Minors

Based on Article 54 of the Family Code of the Russian Federation, children are inseparable from their parents (if possible).

In accordance with this, the temporary registration for the child is extended along with the registration of his parents (when they are issued a patent, employment contract, residence permit, etc.). The same provision is confirmed by paragraph 3 of clause 12 of Government Resolution No. 713.

It states here that if a child is registered at the same address as his parents (other legal representatives), he does not need to obtain permission from the property owners.

In the usual case, a foreign person does not provide additional certificates to renew registration.

The period increases automatically when grounds for staying in Russia arise: obtaining a residence permit, concluding an employment agreement, etc.

If representatives of the Main Department of Migration Affairs of the Ministry of Internal Affairs ask a question about the delay in registration, the foreigner must provide evidence of legal presence in the state.

What documents are needed to renew registration for a citizen of the Russian Federation? Passport, application and certificate confirming the right to register in a specific premises (consent from the owner, rental agreement, etc.).

An employment contract must be concluded before the expiration of the 90-day permitted period of stay of an Armenian citizen in the Russian Federation. This point is important, since if you miss such a deadline, then the legislation of the Russian Federation provides for a quite decent fine in the amount of 2000 to 5000 rubles, and for Moscow/St. Petersburg and their regions the fine can reach even 7000 rubles (Article 18.8 of the Administrative Code).

Having concluded an employment contract on the territory of the Russian Federation, the period of permitted stay of a citizen of Armenia is extended for the duration of such contract. There is a nuance here: a temporary residence permit is issued taking into account the quota approved by the Government of the Russian Federation, but if there are grounds for obtaining a temporary residence permit in a simplified manner, then a quota is not required. There are no additional benefits provided for citizens of Armenia when receiving a temporary residence permit.

Some citizens of Armenia, in order to obtain a temporary residence permit without a quota, marry a citizen of the Russian Federation, but this should not be done, since there may be adverse consequences. If employees of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs of the Russian Federation become aware of the fictitiousness of the marriage, the foreign citizen’s temporary residence permit will be cancelled.

To obtain a temporary residence permit, an Armenian citizen must submit the following documents (general list) to the territorial unit of the Main Directorate for Migration of the Ministry of Internal Affairs of the Russian Federation at the place of registration and actual stay in the Russian Federation:

  • migration card;
  • identification document of a foreign citizen;

  • certificate of proficiency in the Russian language, knowledge of Russian history and the basics of Russian legislation;
  • receipt of payment of state duty in the amount of 1600 rubles;
  • photographs 35x45 mm.

Documents in a foreign language must be translated into Russian and notarized.

To submit documents for a temporary residence permit in a simplified manner, you will also need to attach documents confirming preferential grounds. Reasons for refusal to issue a temporary residence permit:
