Legal assistance in obtaining Russian citizenship

Another reason to seek help in obtaining citizenship is to determine the basis and procedure for its registration. To do this, it is worth at least getting expert advice.

Russian citizenship can be acquired according to a simplified and general scheme. The list of grounds for obtaining citizenship in a simplified manner is established by Federal Law 62-FZ “On Citizenship of the Russian Federation” (05/31/2002). The main ones:

  • by place of birth - if the place of birth is the RSFSR;
  • by kinship – one or both parents are citizens of the Russian Federation;
  • by marriage - after three years of marriage with a citizen of Russia;
  • if children over 18 years of age are citizens of the country, and the person wishing to obtain citizenship is recognized as disabled due to age or health condition;
  • native speakers of Russian (Article 33.1).

Every year, the President and Government of the Russian Federation are making it increasingly easier to obtain citizenship, especially for residents of neighboring countries. The list of people who have the opportunity to obtain Russian citizenship much faster and without any problems is constantly expanding. In order not to waste time, it is better to turn this issue to professionals.

When do you need legal advice on citizenship?

You need to use the services of a lawyer in situations involving the formation of relationships with government bodies of the Russian Federation that provide documents for acquiring citizenship. Legal advice is needed in the following situations:

  • It is required to organize a legal examination confirming the authenticity of documents serving as the basis for acquiring Russian citizenship;
  • Translation of legal documents drawn up in another country, their certification by a notary;
  • Drawing up legal complaints to the court in the event of an unlawful refusal by FMS employees to obtain citizenship.

It is recommended to obtain advice from a lawyer on citizenship issues before arriving in the Russian Federation, so that he can explain how to enter the country legally in the presence of previously imposed restrictions, such as deportation, entry ban. Extensive consultation on these issues is needed to prevent misunderstandings during visa and passport control at the border.

A necessary condition for obtaining citizenship, in most cases, is the preliminary issuance of a temporary residence permit (TRP) in Russia. Each federal district of the country receives a certain number of quotas per year. The lawyer will provide advice on issues related to the number of temporary residence permit quotas available in a particular region of the country and will provide support during registration.

Legal assistance is needed when registering and obtaining documents that allow you to draw up employment contracts, without which it is impossible to confirm relationships with employers in Russia. Lawyers help in matters of dual citizenship.

You will need legal advice on citizenship issues in the following legal situations:

  • Realization of inheritance rights by foreign citizens or Russians wishing to receive property bequeathed to them located abroad;
  • Marriage with foreign citizens;
  • Divorce of Russians from foreigners living in the Russian Federation on the basis of a temporary residence permit;
  • Simplified procedure for granting Russian citizenship;
  • Deprivation of Russian citizenship;
  • Refusal of a citizen from second citizenship;
  • Resolving issues with stateless people.

Foreigners need legal advice on issues of Russian citizenship in the following situations:

  • It is necessary to acquire citizenship for a minor child whose parents are Russians;
  • It is required to obtain citizenship for the parents of a child born in the Russian Federation and who is a Russian by default;
  • Acquisition of citizenship by foreigners who meet the requirements imposed by law;
  • A person who has lived in Russia for at least 5 years and has a residence permit wants to become a Russian.

On what basis can I get a refusal and what to do next?

Russian legislation is friendly to foreign citizens and stateless persons wishing to obtain citizenship. This does not mean that it is given to everyone. Refusal to obtain citizenship can be obtained for the following reasons:

  • false documents were submitted;
  • deliberately false information is provided;
  • there is an outstanding criminal record (serious, especially serious crimes), regardless of the place of commission;
  • a person recognized as posing a potential threat to the security of the citizens of the country or its constitutional order;
  • the applicant supports terrorist activities.

You can appeal a refusal, but this can only be done after a year. Legal assistance in obtaining Russian citizenship is mandatory if a negative decision was received due to failure to comply with registration nuances that the applicant may not have known. In this case, the repeated application may be accepted much earlier than the deadline. If a migrant is completely sure that his citizenship was denied unreasonably, he can contact a higher authority of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs or the court.

By applying for help in obtaining Russian citizenship, the applicant can be sure that the documents will be submitted in full and in accordance with legal requirements.
Registration of Russian citizenship independently or with the help of lawyers.

Obtaining Russian citizenship

Obtaining Russian citizenship, lifting the ban on entry into the territory of the Russian Federation, obtaining a residence permit, collecting the necessary documents according to the list, formalities that must be observed when going through the procedure - all these issues worry people who are faced with the need to solve the migration problem for the first time. Our lawyers will help solve any of these legal problems by providing highly qualified legal assistance.

The legislative framework

The Russian Federation has always been a fairly attractive country for migrants, so its legislative framework clearly regulates the procedure for temporary stay, work and obtaining a residence permit or full citizenship. The main regulatory documents are:

  • “On citizenship of the Russian Federation”;
  • “On the procedure for exit and entry from/to the Russian Federation” dated August 15, 1996 No. 114;
  • “On the legal status of foreign residents in Russia” dated July 25, 2002 No. 115;
  • “On migration registration of residents of foreign states and persons without citizenship in the Russian Federation” dated July 18, 2006 No. 109;
  • other government regulations and orders of the Federal Migration Service of Russia.

Immigration and Citizenship

Current legislation entrusts the regulation of immigration flows to the Federal Migration Service, whose main task is to monitor and control migration flows.

There are two ways to obtain Russian citizenship: in general or simplified (special) order. The conditions for obtaining Russian citizenship are prescribed in Article 13 of the Federal Law “On Citizenship of the Russian Federation.” A person applying for Russian resident status must:

  • have full legal capacity;
  • age from 18 years;
  • legally reside in Russia for five years and be officially registered at the place of permanent residence;
  • during a 5-year period, do not leave the territory of the Russian Federation for more than 90 calendar days per year;
  • have a permanent source of income and declared funds in the amount necessary to ensure a minimum existence;
  • not have a record of being reported to the police and not violate laws and social norms of behavior in the Russian Federation;
  • confirm knowledge of the Russian language by passing special exams;
  • not have passports of other countries, and if they have them, declare renunciation of citizenship of these countries.

The special procedure for processing submitted documents does not require applicants to reside in the Russian Federation for more than five years. The following can apply for a Russian passport using a special form:

  • persons whose parents reside in Russia on a permanent basis;
  • those who do not have citizenship, but were previously subjects of the USSR and live in one of the former republics;
  • have been in an officially registered marriage with a citizen of the Russian Federation for more than three years;
  • have a child who is a citizen of the Russian Federation;
  • have been doing business for more than three years or have received a Russian prof. education after July 1, 2002;
  • investors who meet the criteria described in Article 14 of the Federal Law;
  • have significant generally recognized scientific achievements either in the field of sports, culture, technology, as well as having a profession of significant interest to Russia;
  • political refugees;

Documents that must be submitted to the FMS to obtain Russian citizenship

In order for your application for citizenship to be considered, you must collect the following package of documents:

  • statement of desire to accept citizenship of the Russian Federation;
  • an identity card of another state or a document of a stateless person;
  • a certificate confirming the applicant’s place of residence;
  • 3 photographs with dimensions 3X4;
  • a receipt confirming payment of the state fee;
  • if the applicant has previously changed personal data, in particular, full name - a document confirming the completion of this procedure;

If an applicant applies for consideration of his application under a simplified procedure, he must present:

  • for workers in culture, science, and other industries who have significant achievements or whose services are in demand and cannot be replaced by local labor resources - a petition from the federal government or a senior official with arguments about the need to grant Russian citizenship out of turn;
  • for political refugees - an appropriate document that confirms the legal receipt of this status;

After submitting a package of documents, the application will be reviewed and a decision will be made on it. The law allows one year from the date of adoption to make a decision.

In some exceptional cases, citizenship can be granted without waiting lists by decree of the President of Russia without any additional requirements.
