How to get a residence permit in Russia in 2021

In order to legally work and live in Russia, citizens of other countries must correctly obtain a residence permit. To do this, a residence permit is issued in the following order:

  1. Residence in the Russian Federation for more than one year with a temporary residence permit patent, without violating the law.
  2. Preparation of a package of documents.
  3. Filling out an application, providing a package of documents to employees of the Main Migration Department of the Ministry of Internal Affairs.

To obtain a patent on a general basis, you must have a valid temporary residence permit.

The process of obtaining special status takes about six months. Given the length of bureaucratic procedures, it is worth preparing in a timely manner

Sequence of obtaining a residence permit:

  1. Filling out the application from the Main Directorate of Migration Affairs of the Ministry of Internal Affairs strictly according to the provided sample.
  2. Take a Russian language test. Citizens of Belarus, children, pensioners, and foreigners with a diploma from a Russian university pass without an exam.
  3. Provide a medical certificate with a fresh stamp.

About changes to legislation

Let us note right away: a new law that regulates the issuance of temporary residence permits and residence permits has not appeared. Federal Law-115 “On the legal status of foreign citizens...” is still in force. But on August 2, the Russian president signed Law No. 257. This regulatory act makes changes to the above-mentioned Federal Law-115.

The innovations affected the issuance of temporary residence permits and residence permits. And if there are not many changes in the temporary residence permit, then the article regarding the issuance of a residence permit has been completely rewritten. Issuance of a residence permit without a temporary residence permit

Despite the hopes of many migrants, the temporary residence permit was not eliminated; it is still valid. That is, you will still have to go through a step-by-step process: first obtain a temporary residence permit, and then a residence permit.

But thanks to the amendments, many will be able to obtain a permanent residence permit in the Russian Federation without a temporary residence permit . That is, a person will simply come to Russia, register for migration here, and then, without a temporary residence permit, will immediately be able to apply the papers to permanent resident status. This simplification is available if the following grounds exist:

  1. If a person was born in the RSFSR , then he will be able to obtain a permanent residence permit in the Russian Federation without first obtaining a temporary residence permit. But what is important here is not only the fact of birth in the RSFSR, but also the presence of Soviet citizenship in the past . Note that we are talking only about immigrants from the RSFSR. It is one of the former republics of the Soviet Union, which became the Russian Federation after the collapse of the country.
  2. The procedure has been significantly simplified for children under 18 years of age and incompetent adult citizens . Now they will immediately be issued a residence permit if one of the parents has already been granted residence permit status, or if a child/incapacitated person receives a residence permit together with a parent. Instead of a mother/father, there may also be a guardian, adoptive parent or trustee.
  3. Another situation that will make the procedure easier for a huge part of migrants is when a foreigner has a parent or son/daughter with Russian citizenship. It is important that the Russian relative resides in the Russian Federation and has permanent registration here (stamp in the passport). In this case, age is not important: a child can be either an adult or a minor, a parent can be either of working age or a pensioner.
  4. , native speakers of the Russian language (NRN) will receive the status . This rule for NRN was in effect before, but now it is spelled out in Law 115. Note that we are talking specifically about citizens who participate in the Russian speaker program, and not about foreigners who know Russian well. To become a NRN, you need to pass a special commission and receive the appropriate document.
  5. Foreign citizens who work in Russia in a profession from the list of the Ministry of Labor . Representatives of professions from this list can subsequently obtain citizenship according to a simplified scheme. In order to obtain an indefinite residence permit in the Russian Federation without a temporary residence permit, you need to work in your specialty for 6 months. And only in Russia. It is important that the registration is official, and that the employer makes all the deductions required by law. All this will be checked when issuing the status.
  6. Graduates of Russian universities who graduated from an educational institution with honors will also receive status without unnecessary bureaucratic red tape. Important points for this basis: the university must be located in the Russian Federation, the graduate must graduate with honors. It is also necessary that the educational organization and program in which the migrant studied have state accreditation.
  7. Highly qualified specialists . As we noted above, this is the only category of citizens who will be issued a residence permit with a limited validity period.
  8. People whose Russian citizenship was revoked. This basis also covers a fairly large part of the population. It affects those people who had Russian citizenship, but were subsequently deprived of their passport, due to the fact that the issuance of citizenship was considered unfounded. Left without a passport, they will be able to immediately apply for a residence permit. The only category of citizens who will not be issued a residence permit in a simplified manner are those who were deprived of citizenship due to crimes related to terrorism and extremism.
  9. Citizens who were deported from the Crimean Autonomous Soviet Socialist Republic , as well as relatives of such people in a direct ascending or descending line. This basis existed before. However, applicants from this category are extremely rare.

Despite the fact that the residence permit in the Russian Federation is now unlimited, notifications still need to be submitted every year. The procedure itself remains the same as before - you need to fill out a notification form, indicating your address of residence, place of work, level of income, indicating the periods of stay abroad. You need to contact the post office or the migration department of the Ministry of Internal Affairs with this form and documents.

But the annual marks have also undergone some changes. Firstly, the law has finally clearly outlined exactly when notifications need to be submitted. Migrants will do this within two months after the expiration of each year of residence under a residence permit.

Previously, regions had different requirements for confirmation deadlines. If the holder of a residence permit does not make annual notifications for two years in a row, his status will be revoked. Therefore, this procedure should be taken seriously.

One more point - every fifth year of residence on a residence permit, such notes must be made personally through the migration division of the Ministry of Internal Affairs. That is, if you are used to submitting notifications via mail, then every fifth year of staying in the Russian Federation with a residence permit you need to come to the Ministry of Internal Affairs to carry out this procedure.

Before changes were made to the law, there was wording according to which permanent resident status would be revoked if a person stayed abroad for more than 6 months. But whether this period was counted in total for a year or whether it meant a one-time departure was not specified.

As a result, this rule was interpreted differently in different regions. In some places it was possible to go to another country for 6 months, then return to Russia for three days and leave again.

Now the law clearly states that you cannot stay abroad for more than 6 months during the year.

That is, the total period of your stay outside Russia per year should not exceed 180 days.

Cancellation of a residence permit at your own request

This innovation also made migration processes in Russia simpler and more understandable. Previously, foreign citizens did not understand how to act if they no longer needed a residence permit in Russia. There was no provision for voluntary cancellation.

From November 1, any person who no longer needs a residence permit can write an application to cancel their status and safely go home or to another state.

Status can still be revoked for violating the law

Article 9 of Federal Law No. 115, dedicated to the revocation of status, has not gone away. Yes, and minimal changes were made to it.

As before, status is taken away if a person violates the period of stay abroad, does not comply with migration legislation, or does not provide documents confirming that he is able to support himself.

The presence of a permit gives pensioners and citizens of foreign countries the right to receive the following types of pensions: insurance, funded, and state pensions. When submitting an application six months after receiving a temporary residence permit, a pension certificate is attached.

When filling out an application a year after receiving the temporary residence permit, you need to collect a complete package of documents and contact the FMS again at your address of residence. It is worth noting that the income certificate is provided by the person who is dependent on the foreign person. If you are earning the minimum wage, you will additionally have to provide a certificate of availability of a bank account.

What documents are needed for a residence permit in Russia in 2021

To obtain the appropriate permit, a foreign applicant needs to prepare a complete package of documents. It includes:

  • application in two copies, filled out according to the standard form;
  • original passport;
  • a valid temporary residence permit;
  • four photographs measuring 35x45 mm;
  • medical report;
  • certificate of completion of courses in the discipline “Russian language”;
  • original and copies of the work book, 2NDFL certificate, bank statement;
  • registration document;
  • receipt for payment of state duty.

In some cases, the case may require the following additional documents:

  • marriage certificate with a citizen of the Russian Federation;
  • document on ownership of real estate in Russia;
  • a document certifying family ties with a citizen of the Russian Federation.

If one of the above documents is provided in a foreign language, you will need a notarized translation.

What is a residence permit

First, let’s define what a residence permit is and why it is needed. A residence permit (RP) is a document that allows foreign citizens and stateless persons to work and live in the Russian Federation for five years. As a rule, a residence permit is issued only after a temporary residence permit has been received. The exception is citizens of Turkmenistan, Belarus and other foreigners. At the end of the five-year period, documents can be submitted for citizenship. Having received a residence permit, foreigners will be able to work without obtaining additional work permits. But at the same time, it is worth remembering that the employer must be notified of the validity period of the residence permit and that within 3 days from the date of concluding an employment contract with the holder of the residence permit, he is obliged to inform the Main Department of Migration Affairs about the hiring of a foreign employee. In addition, a residence permit allows a foreigner, on the same basis as citizens of the Russian Federation, to receive a loan from a bank. The same rules for applying for a loan will apply to them as for citizens of the Russian Federation. However, banks are reluctant to provide regular loans to foreigners, but it will be quite possible to get a mortgage loan. In this case, the purchased housing remains pledged to the bank until the loan is repaid, so credit institutions are willing to accept such transactions.

In other words, a residence permit is a document that replaces a passport within the Russian Federation. It should be remembered that obtaining a residence permit does not mean losing the citizenship of your country.
