Working in Russia for LPR citizens is an issue that interests many residents of the unrecognized republic. The fact is that such people have certain difficulties with their legal status. Formally, while the ATO continues, and the Minsk agreements work only on paper, from the point of view of Ukrainian legislation they are citizens of Ukraine. On the other hand, back in 2014, the Supreme Council of the LPR adopted the Declaration “On Citizenship,” according to which all people who were permanently residing on its territory at the time of the referendum, in which residents of the former Lugansk region voted for independence from Ukraine, were declared citizens of the republic.

Citizens are considered to be persons who permanently resided in this territory and were registered there, but at the time of the survey for some reason found themselves outside its borders. The LPR passport can be obtained since 2015.

The legal status of the migrant worker plays a secondary role here. It is much more important to have professional qualifications that are in demand in your field.

Algorithm of actions for employment

Despite the fact that Ukrainian citizens are hired according to a simplified procedure, this does not exempt them from the need to obtain a migration card. In addition, an employer offering vacancies to foreigners must itself have the appropriate permission from the Main Directorate for Migration Affairs of the Ministry of Internal Affairs.

The rules for the entry of Ukrainians into Russia allow crossing the border for the purpose of a private visit or subsequent employment. When passing the checkpoint, citizens are not required to declare that they intend to find work in Moscow. This can be done after a suitable vacancy has been found.

The algorithm for legalizing a foreigner depends on the method of employment. A citizen of Ukraine who came to Russia to look for work can choose one of the following options to obtain the necessary legal status:

  • buy a work patent (depending on the method of document execution, it will cost from 1,600 to 14,000 rubles);
  • apply for refugee status;
  • obtain a temporary residence permit (residence permit);
  • conclude an employment contract with an employer who has permission to provide vacancies to foreigners.

If a person wants to start a business and wants to find out how to open an individual entrepreneur for a citizen of Ukraine in Russia, then first he will still have to legalize his presence in the Russian Federation. It will be possible to submit documents to engage in entrepreneurial activity only after receiving a temporary residence permit.

Formally, they are considered citizens of the LPR, but not all of them managed to obtain a passport of the Republic, so they remain citizens of Ukraine. As a rule, they can only present a Ukrainian passport as the main document, but officials and employers usually treat this with understanding, so they also have the opportunity to get a job. However, in this case, a shift is not the most profitable option. After all, people who have received temporary asylum, by law, still cannot travel outside the country. Secondly, citizens of the LPR who do not intend to permanently reside in the territory of the Russian Federation can also get a job in Russia. The shift is suitable for them, since it involves living on site for up to 6 months. In December 2021, the Government of the Russian Federation adopted a resolution that immigrants from the LPR and DPR can stay in Russia on the basis of their documents for no more than 180 days (previously this period was 90 days). And since, despite the recognition of the republic’s passports, for Russia, residents of the LPR still remain citizens of Ukraine, compliance with these deadlines is very important. Not only workers work here on a rotational basis, but also doctors, medical staff, and engineers, because the salaries of doctors and physicians in Russia are higher than in Ukraine.

Registration of a patent

A significant part of Ukrainian citizens working in Moscow or other Russian cities prefer not to obtain a residence permit, but limit themselves to purchasing a patent. This option has advantages for those who intend to settle in the Russian Federation for only a few months.

A work patent for citizens of Ukraine can be issued independently or through an intermediary. If a migrant worker decides to receive this document without engaging the services of an agency, then he needs to contact the Main Migration Department of the Ministry of Internal Affairs at his place of actual residence. It is worth considering that any paid work without a patent will be considered illegal. This will result in a fine of 10-15 thousand rubles being imposed on the foreigner, and may also lead to deportation.

The answer to the question of how much a patent costs depends on the specific region of the country. In Moscow and other large cities, a work permit costs from 3,000-4,000 rubles. In regions that are less in demand for labor migration, the state fee for a patent will cost an amount starting from 1,568 rubles. Quite often, the employer issues the permit by deducting the cost of obtaining the document from the first salary.

The patent has a validity period of 1 to 3 months, but can be extended up to a year. Refugee status in Russia for Ukrainians provides the opportunity not to apply for a work permit, since this right is provided for when issuing a residence permit. However, if such a citizen wants to engage in business activities in the Russian Federation, then he will need to have the appropriate license from local authorities.

To register a patent at the Main Directorate for Migration Affairs of the Ministry of Internal Affairs, you must provide:

  • a completed application of the established form;
  • general civil or foreign passport of a citizen of Ukraine;
  • migration card;
  • a health record or a certificate from a clinic confirming the absence of HIV, tuberculosis, or drug addiction;
  • voluntary medical insurance policy;
  • certificate of proficiency in the Russian language, basic legislation and history of the Russian Federation;
  • photograph 3.5 by 4.5 cm.

Employment without a patent is against the law and can lead to serious problems, including deportation. However, not only the employee, but also the owner of the company that hires him should be interested in obtaining a work permit. Otherwise, he will face a significant fine.

A work patent may be refused for the following reasons:

  • absence of one or more documents when submitting an application to the Main Department of Migration of the Ministry of Internal Affairs;
  • violation of the period of stay of a foreign citizen on the territory of the Russian Federation;
  • previous offenses that resulted in deportation from Russia, administrative or criminal punishment;
  • the foreigner has infectious diseases.

How to legally get a job?

Citizens of both unrecognized republics present a document at the border checkpoint and fill out a migration card, the form of which is issued there. Regardless of whether the purpose of the trip to Russia is a shift or work under another system, you still need to select the word “work” in this card in the corresponding column about the purpose of entry.

Within 7 working days from the moment of arrival, citizens are required to register at their place of residence with the Ministry of Internal Affairs. As a rule, this entire bureaucratic procedure is undertaken by the receiving party, including legal entities, that is, the enterprise where the person intends to work.

The period of temporary stay in the Russian Federation for citizens of Ukraine, which in fact are residents of the LPR, is 180 days. The shift cannot last more than 180 days (and by law you cannot work more than 12 hours a day).

By law, citizens of Ukraine can extend this period if they have an employment or civil contract under which they perform work or provide services. Then the period of stay will be extended for as long as the agreement is in force, but not more than for a year, which is counted from the moment this citizen enters the territory of the Russian Federation.

To fulfill this condition, you need to provide the contract itself and additional documents (they are submitted within 30 days from the date of receipt of a work permit in Russia). These are duly completed medical certificates stating that the applicant is not a drug addict and does not suffer from infectious diseases that are dangerous to others. If a citizen of the LPR is going to apply for a temporary residence permit and has not yet found a job, then he will have to do the paperwork himself. The Russian system is not overly complex, so there shouldn't be any major problems.

Temporary residence permit

An alternative to obtaining a work patent is naturalization in the Russian Federation, the first stage of which will be obtaining a TRP (residence permit). This makes it possible for a foreign citizen not only to legally find a job or open his own business, but also subsequently to obtain Russian citizenship.

A residence permit in Russia is issued for 3 years and cannot be renewed. Work under a temporary residence permit for foreigners is formalized on the same basis as for Russian citizens. To obtain a residence permit, you must contact the Main Migration Department of the Ministry of Internal Affairs at your actual location. The submitted application and accompanying documents are reviewed by the migration service within 60 days, after which the foreigner is issued an official decision.

In case of refusal to provide a temporary residence permit, a citizen can appeal it in court or by filing an appeal to higher territorial bodies of the Ministry of Internal Affairs of the Russian Federation.

What documents will be required from you when applying for employment with a temporary residence permit?

The list of securities is given in Articles 65 and 327.3 of the Labor Code of the Russian Federation. If you have received a place in an organization, then, as of 2021, you will need to provide:

  1. Passport.
  2. Work book. The document is not required if the employee has never worked before or if it is issued part-time. Also, the book does not need to be provided if such a document is not used in the foreign employee’s home country.
  3. SNILS. It is registered with the Pension Fund at the place of permanent residence. If you are employed for the first time, the employer provides the insurance certificate.
  4. TIN. Receive the document from the tax office at the place of registration.
  5. Compulsory health insurance policy. To obtain a compulsory medical insurance policy, contact any insurance company. The document allows you to visit doctors free of charge, receive treatment in government institutions, and take out sick leave.
  6. In some cases, the employee is required to provide a military registration document and a certificate of absence of administrative violations related to drug use .

Cities with the highest salaries

Since the goal of labor migration is always financial well-being, Ukrainian citizens planning to find work in Russia need to clearly understand the current situation on the labor market in various regions of the country. This will allow you to choose the most suitable city for moving.

As of 2021, federal subjects with high wage levels were as follows (according to Rosstat):

  • Yamalo-Nenets Autonomous Okrug – 71,000 rubles;
  • Moscow – 65,000 rubles;
  • Khanty-Mansi Autonomous Okrug – 62,000 rubles;
  • Nenets Autonomous Okrug – 59,500 rubles;
  • Chukotka Autonomous Okrug – 56,000 rubles;
  • Magadan region – 56,000 rubles;
  • Yakutia – 53,500 rub.

If we take into account only the European part of the Russian Federation, as the most popular for labor migrants, then the highest level of average wages was recorded in the following regions:

  • St. Petersburg – 45,500 rubles;

Popular specialties in the Russian Federation

Foreign citizens interested in finding high-paying jobs in Russia should take into account that, in addition to geographic location, specialist qualifications play an important role in the labor market. If a person has professional skills that can only be in demand in a certain field, then there is a risk that the wrong choice of region will lead to the fact that he will not be able to find suitable vacancies for himself, despite his education and extensive experience in his previous place of work.

At the same time, it is important to focus not on highly paid, but on demanded specialties. If a person, for example, is going to get a job in Moscow as an architect or a metro train driver, then the salary level here does not at all guarantee the availability of vacancies. On the contrary, a migrant worker will face considerable difficulties in finding work in the wrong field.

If we take Moscow into account, the list of the most in-demand professions in this city looks something like this:

  • Chinese translator;
  • auditor;
  • arbitration manager;
  • programmer (Java, Python);
  • IT manager.

Specialties in demand

In addition to highly qualified specialists, locksmiths, auto mechanics and engineers are consistently in demand in the capital. The list of professions that are required in Moscow and other large cities of Russia can be found on specialized websites or by contacting the employment service.

For men

The lack of high qualifications does not mean that a foreign citizen cannot count on a well-paid job in Russia. In almost all regions of the Russian Federation there are vacancies that are urgently needed by large and small enterprises. This could be, for example, working in the North as a truck or excavator driver or servicing drilling rigs on a rotational basis.

Having applied for a factory or other industrial enterprise, an electric welder or CNC machine operator with many years of experience will certainly be able to find a suitable position. This applies even to those who previously could not find a job in their specialty, but have the necessary education. Assistant workshop manager or second accountant - you can find such vacancies in many Russian cities, not necessarily only in Moscow. You just need to make an effort to find a job.

For women

Is it possible to find a suitable vacancy in Russia without having high qualifications? If we are talking about the capital, where the catering, services and hotel business are widely developed, then there will be no problems with the search. Work in Moscow is available to women from Ukraine on the same basis as for citizens of the Russian Federation. The only condition here is to have legal status in the country.

If we take low-skilled workers, the following vacancies are always in demand in Moscow:

  • housekeeper;
  • housemaid;
  • cook;
  • food seller;
  • nurse (to care for the elderly or sick).

Having high qualifications or extensive work experience in your specialty automatically increases your chances of finding a higher-paying vacancy.
