A new identity document will appear in Russia

Stateless persons will be able to obtain a temporary identity card in Russia. This will become possible with changes in the law on the legal status of foreigners. The draft amendments have been prepared by the Government of the Russian Federation and will soon be considered by the Duma.

The basic concepts of the law of July 25, 2002 are subject to change. The document that is planned to be issued will be called a temporary identity card of a stateless person in the Russian Federation (hereinafter referred to as VUL). The paper, in addition to its identification functions, will allow you to stay on the territory of Russia. The document will exist only on paper; an electronic form is not yet provided.

The draft also clarifies which foreign citizen can be considered temporarily staying on the territory of the Russian Federation. Now this will be a foreigner who arrived on a visa or visa-free basis, with a migration card in hand, but without a residence permit (residence permit) or TRP (temporary residence permit). Soon this will be added:

  • new document (temporary identity card)
  • papers confirming refugee recognition (on acceptance or consideration of an application, or an already issued certificate)
  • papers for temporary asylum in the Russian Federation

Article 5 of the law, which obliges people to travel outside the Russian Federation, will also change. If a new certificate is issued, this obligation is removed.

Registration of temporary residence permit

There is a federal quota for issuing temporary residence permits. It is divided into different regions, but not in equal quantities. Once all quota places are filled, applications are no longer accepted, so you should hurry up with your application.

It is necessary to prepare the following set of documents:

  1. Application in two copies (can be by hand or on a computer, and then printed). You can download the application here, a sample form can be found here.

  2. Two photographs that will be pasted into the application.
  3. Certificate of temporary asylum, since at the moment this is the identity document.
  4. Certificate of no criminal record or acquittal if a criminal case has been opened.
  5. Medical examination of the state of health and the absence of contagious dangerous diseases.
  6. Certificate of passing the Russian language exam.
  7. Documents confirming marital status: marriage certificates, birth certificates of children.
  8. Migration card and information about registration with the migration service
  9. Payment of state duty in the amount of 1600 rubles.

For children you will need the same list of documents. Minors, starting from 14 years of age, must give their consent to reside in the Russian Federation. In addition, children do not need to take a language exam.

All documents provided, if they are in a foreign language, must be accompanied by a translation. The translation must be certified by a notary.

Getting out of quota

Some categories of foreign citizens can receive a temporary residence permit without taking into account the quota. This is especially important for those who are afraid of refusal to extend temporary asylum. Without taking into account quotas, the following can apply:

  1. Those who once had USSR citizenship.
  2. All those born in the Russian Federation.
  3. Legal spouse of a citizen of the Russian Federation.
  4. A pensioner or disabled person whose child currently has Russian citizenship.
  5. Any foreigner whose retired parents live in Russia.
  6. All participants in the program for the voluntary resettlement of compatriots to Russia.
  7. Anyone who decides to serve in the Russian armed forces.
  8. Parents of children with Russian citizenship.
  9. For minors, obtaining a temporary residence permit is outside the quota.
  10. An incapacitated foreigner whose guardian has Russian citizenship.

On August 2, 2021, the President of the Russian Federation adopted Federal Law-257: the full text of the law can be found on the official website https://www.kremlin.ru/acts/bank/44554. It came into force 90 days after its signing. Now citizens of Ukraine and stateless persons permanently residing in the territory of this country can apply for a temporary residence permit without taking into account the quota. When applying outside the quota, you must provide proof of eligibility in addition to the general list. This may be a certificate of participation in a state program, a birth certificate, a marriage certificate and other documents indicating family ties with a Russian citizen.

Document requirements

Collecting the necessary papers is not difficult, but there are some subtleties, knowledge of which can save a lot of time.

Statement

Everyone, except children and the disabled, must complete the application themselves. When filling out manually, you must write legibly; it is better to use block letters. All words must be written without abbreviations; corrections and dashes in lines are not allowed.

If there is not enough space, you can use a simple blank sheet with signed full names as an application. It is better to provide as much information as possible about yourself.

Particular attention should be paid to checking the written data and document numbers. All written information is verified, so it is better not to remain silent about criminal convictions or outstanding fines. If the deception is discovered, the person faces expulsion from the Russian Federation with deprivation of all statuses received.

The size of the photo should be 3.5 x 4.5 cm, and it does not matter whether it is color or black and white. Head coverings are only permitted if required for religious reasons. Glasses are allowed in the photo, but only those that do not hide the eyes; there should be no glare on the glass.

Medical examination

Everyone who wants to receive a temporary residence permit must pass a commission. The examination is carried out for serious contagious diseases, sexually transmitted diseases and HIV infections. The commission is accepted only from certain hospitals; you can find the list in the department of the Main Department of Internal Medicine.

Those who arrived without a visa are given 30 days to undergo a medical examination from the date of application. If you do not bring the certificate, the application will be canceled and you will have to start all over again.

A little about the newest document

A new article, number 5.2, is devoted to the document. The Ministry of Internal Affairs will issue the paper for one year, upon application, within 10 working days. After a year, you will need to apply for an extension - also for a year, until you receive a residence permit or temporary residence permit. The document will contain a number of attributes, as well as a photo of the media.

The certificate will be canceled if the Ministry of Internal Affairs discovers that a stateless person has a residence permit or temporary residence permit of another state. This person can also obtain a certificate to go to the embassy of such a state. You are given 15 days to leave, otherwise you will be held liable.

The Ministry of Internal Affairs will be able to revoke its decisions on issuing certificates in a number of cases. As an example, a decision may be made regarding a foreigner that his stay is undesirable due to the latter creating a threat to the health of the population of the Russian Federation. Or a foreigner may be found guilty of crime, terrorism, etc. phenomena. By the way, probable carriers of COVID-19 may well fall into this cohort.

The issuance of a VUL may be refused. The paper will be issued to those whose residence permit or temporary residence permit has been cancelled. And most importantly, having a VUL will give you the right to work on the territory of the Russian Federation (without permission) and cancel deportation and readmission. Readmission is the agreement of the state to accept its citizen back.

Procedure for granting temporary asylum

This procedure is regulated at the government level by a special resolution. According to it, a person in need of temporary asylum must:

  1. Fill out and submit an application for temporary asylum in the prescribed form. The document is drawn up in Russian, but if the person submitting the application does not speak Russian, in this case it will be necessary to use the services of a translator. For minor applicants, the application must be filled out by a parent or guardian, and in the absence of such, by an official of the migration authority. The application, in addition to autobiographical data, must indicate the motives and circumstances that prompted the person to submit such an application to the migration authorities.
  2. After filling out and submitting the application to the relevant department of the migration service, an interview is conducted with the applicant, in which the migration service official once again orally, using a questionnaire, finds out the motives and circumstances that prompted the person to make such an application.
  3. After the interview, the person is issued a certificate of consideration of the application for temporary asylum. This certificate will serve as confirmation of legal stay in the country for the entire period of consideration of documents, i.e. for three months.
  4. If the order is followed and there are grounds for acquiring status, the issue will be resolved in your favor. In case of difficulties in the procedure, need help or appeal a refusal, you can always contact our migration lawyer.

The procedure for leaving the Russian Federation will also change slightly.

The amendments will affect the relevant law. If the authorities decide not to allow a foreigner to enter Russia, issuing him a VUL will lift the ban. “Unwanted” foreigners who are carriers of infection also cease to be undesirable once they are issued a VUL.

The decision on “banned” foreigners who have become “undesirable” due to possible involvement in money laundering or terrorism is suspended upon receipt of the VUL. If the person has left the Russian Federation, the decision is renewed.

Grounds for granting temporary asylum

The law provides only two grounds for granting a foreign person temporary asylum:

  • the person has grounds to be recognized as a refugee, however, the absence of an application for recognition as a refugee;
  • the person has grounds to be recognized as a refugee, however, for humanitarian reasons, these persons cannot be expelled from the country;

Humane reasons mean:

  • the person’s health condition does not allow him to return to his place of previous residence, due to the lack of access to the necessary medical care in his country of residence.
  • a real threat to the life, health, freedom of a person in his former place of residence due to hunger, emergency situations, war or other local conflicts;
  • there is a real threat to the person that he will be subjected to unfair punishment in his place of previous residence, by applying torture or other inhumane punishment to him;

Please note that this list is not exhaustive; each case is considered individually.

Why is all this needed?

The main executive body explained the need for a new document as follows. There are about 5 thousand people in the Russian Federation at the same time without an identity document. These are the faces:

  • those released from prison, but with a criminal record that has not been expunged (not expunged), who have been decided to be deported, but have nowhere to go
  • former citizens of the USSR (including their children), but who arrived in the Russian Federation after November 1, 2002 and did not receive citizenship (or their passport was confiscated)
  • persons with revoked citizenship, or citizens without a place of residence (so-called homeless people)
  • “undesirable” foreigners who are decided to be deported, expelled, etc.

The document is intended to consolidate the legal status of these persons and make their existence easier. The amendments were adopted as a result of the adoption by the Constitutional Court of Russia of Resolution No. 14-P of May 23, 2021.
