New law on extension of residence permit

In 2021, a lot of changes were made to the law “On the Legal Status of Foreign Citizens”. The main one concerned the duration of the residence permit - this status became indefinite. But what about foreigners who still have old, five-year residence permits? The authors of the new law, of course, foresaw this point.

All residence permits issued for five years remain valid. According to them, you can, as before, legally live in Russia and apply for citizenship. If you do not plan to stay in the Russian Federation for a long time, then you can stay here using the old residence permit until its term comes to an end. After this, the status will be canceled, and its holder will need to leave Russia.

If you plan to live in Russia for a longer period of time, then closer to the end of the five-year residence permit you need to exchange it for an indefinite one.

How long before the end of a five-year residence permit can I change it to an indefinite one?

There is no answer to this question in the laws. The regulations for issuing a residence permit (Order No. 417), namely paragraph 2.17 , say that you can apply for an indefinite residence permit during the validity period of the old document . That is, according to the regulations, it turns out that you can submit an application even on the last day of validity of the residence permit. But we do not recommend delaying this procedure and still do everything in advance.

Judging by the reports of foreign citizens, in different regions, departments of the Ministry of Internal Affairs set their own deadlines - in some places they ask to bring documents a month before the expiration of a five-year residence permit, in others - 4 months. Therefore, check this question in the department where you will change your residence permit.

Reasons for receiving

When applying for a residence permit, a citizen of a foreign state is based on Article 8 of the Federal Law, which regulates the legal status of a non-resident of the Russian Federation. The law specifies the grounds for obtaining a residence permit in the cultural capital. A foreigner must comply with at least one of the points.

The migrant must be:

  • holder of a temporary residence permit for a period of at least 1 year;
  • native speaker of Russian;
  • refugee;
  • a member of a government project that focuses on the voluntary migration of fellow citizens;
  • highly qualified specialist;
  • citizen of Belarus;
  • a parent whose children live in the Russian Federation;
  • former resident of the USSR;
  • graduate of accredited universities (with honors diploma).

Documents for renewal (exchange for permanent) residence permit

Clause 43 of the Regulations for issuing a residence permit lists only three documents for replacement: photographs, a passport and proof of knowledge of the Russian language. But, as a rule, inspectors actually require a longer list. Below is a list that usually needs to be collected for replacement (but we recommend that you check the list with your migration office so as not to prepare unnecessary paperwork):

  • Application for a permanent residence permit:
  • Passport – to extend, or rather replace, a residence permit, you will need to make a notarized translation of your passport;
  • Old residence permit + copies of pages with marks;
  • Photos, 2 pieces, the same parameters as for the initial residence permit – 35x45 mm, black and white or color. Other photo requirements follow the link;
  • State duty. When replacing with a residence permit, you need to pay a state fee. The sizes are the same as for the initial receipt of status - 5,000 rubles;
  • A document confirming knowledge of the Russian language.

They may also ask for receipts of annual notifications for residence permits, notification of migration registration, if there is no registration stamp at the place of residence.

There is no requirement to undergo a medical examination when renewing a residence permit. There is no need to confirm income. If you received your first residence permit (which is five years old) before January 1, 2015, then you do not need to confirm your knowledge of the language. That is, you do not need to present educational documents or bring a certificate of passing the residence permit exam. If you received a residence permit before January 1, 2015, then a certificate is needed. How to get the service?

To replace a temporary residence permit with an indefinite one in 2021, you only need to take a few steps. To begin with, you will have to collect a small package of documents (about half of what was submitted during the initial registration). To obtain a new residence permit, they pay the same state fee (5 thousand rubles).

Methods for applying and receiving results

An application for extension can be submitted in person to the Migration Department of the Ministry of Internal Affairs nearest to you, sent by registered mail, or sent online through the State Services portal.

For personal submission:

  1. Select the district office of the Main Department of Migration Affairs of the Ministry of Internal Affairs of Russia at your place of residence.
  2. Fill out the application form on site (download a sample here).
  3. Pay the state fee at the cash desk and submit a package of documents (application, passport, photo, old residence permit).

The result will be the issuance of a completed permanent residence permit document. It can be picked up in person at the Ministry of Internal Affairs office.

To apply online:

  1. Log into your personal account on the State Services website: www.gosuslugi.ru.

  2. Select the option “Extension of residence permit” and fill out the online form.

After submitting your application, expect an invitation for an interview. You need to have original documents, a passport and money to pay the state fee. Due to the coronavirus pandemic, appointments are by appointment only.

The result of the service is the same - receiving a residence permit document without an expiration date. It will most likely be issued on the same day upon personal application by the applicant.

Sending documents by mail is also possible:

  1. To do this, create a package: fill out the application form (see above), take a photo and have the translation of your passport certified.
  2. Pay the state fee of 5 thousand rubles in advance and keep the receipt.
  3. Send the documents by registered mail to the Main Migration Department of the Ministry of Internal Affairs, where the residence permit was issued.
  4. Next, you will be contacted and informed when you need to pick up the completed paper sample residence permit.

Please note that given the work of the Russian Post, the deadline for renewing the document may be delayed. You will also have to call and check whether the documents have arrived and what number your application is registered under (see sample above). Cost and payment procedure

The cost of a residence permit consists of the amount of the state duty. In 2021 it is 5 thousand rubles. Notarization of a passport translation will cost from 900-1 thousand rubles. Payment must be made according to the details indicated on the website of the Main Directorate for Migration of the Ministry of Internal Affairs of Russia.

Terms of service provision

The residence permit is renewed in 7-15 days. When submitting the package, you will be given a certificate of acceptance, which will indicate the date. Count down 60 days and expect to receive a new residence permit within this time frame.

Result of service provision

“At the exit” the foreigner receives an indefinite residence permit, which does not need to be renewed after 5 years. Such a document gives the right to long-term residence in the Russian Federation, work, open a business, receive a pension upon reaching retirement age, as well as many other benefits available to Russians.

A residence permit actually differs from citizenship only in the inability to vote in elections or participate in the electoral process, as well as the ban on military service, receiving maternity capital, preferential family, and military mortgages.

You only need to notify the Ministry of Internal Affairs annually about your work and place of residence (you can do this by mail). We are talking about sending a completed notification form (download a sample here). Once every five years, this document is entered in person and not sent by mail.

Validity periods

The residence permit has no expiration date. If you decide to apply for citizenship, you will receive a Russian passport instead. But the Main Directorate for Migration Affairs of the Ministry of Internal Affairs has the right to cancel a residence permit in case of violations of the migration regime committed by a foreigner (for example, staying outside Russia for more than 6 months a year).

Therefore, it is still premature to say that a residence permit is issued forever. Practice shows that this document can easily be lost without notifying the Ministry of Internal Affairs every year and allowing other violations.

UPD: as of November 2021, the residence permit has been made indefinite. It no longer needs to be renewed every five years. We described above the procedure for exchanging an old residence permit for a permanent one. Below is information about extending a residence permit for five years. This exchange is no longer being carried out, so the INFORMATION BELOW IS NO LONGER CURRENT! Read about the permanent residence permit at the link.

A foreign citizen receives temporary resident status for five years. The good news is that it can be renewed for another five years. This is provided for in Part 3 of Article 8 of Federal Law-115 “On the Legal Status...”.

There are no restrictions on the number of renewals for 2021. Accordingly, the status can be extended at least until the end of life.

Established deadlines for renewal of residence permit

Extension of a residence permit is allowed within the legislative framework (Law No. 257-F3, Article 1, paragraph No. 3, August 2, 2019) and only if the following rules are observed:

  • no later than 30 days from the occurrence of the event, after which the document cannot be used in the future;
  • upon citizens reaching 14, 20 or 45 years of age;
  • in case of detection of errors and inaccuracies made during filling out the document;
  • if a foreigner changes his full name, other data, gender, the replacement is carried out within ten days from the date of issuance of documentary evidence of the fact.

Replacing a residence permit in Russia with a permanent certificate is possible at any convenient time, as long as it is valid.

The main rule is to renew on time

Not all migrants are warned that their residence permit is renewed strictly within a certain period. An application for extension must be submitted no later than two months before the expiration of the residence permit . This can be done in advance - six months before the status burnout.

For example, the status is valid until August 25, 2021. This means that you can submit documents for renewal from February 25, 2021. And the application deadline is June 25, 2021.

We recommend acting in advance, since an application for renewal of a residence permit may not be accepted the first time, for example, due to errors in the form or if an incomplete package of papers is provided. Then the person will have time to correct the shortcomings.

What happens if you don't renew your status on time?

In this case, two options are possible:

  • If a foreigner did not timely renew his residence permit for a good reason (illness, emergency), then he has the right to submit an application later than the deadline (if he has documents confirming a good reason). But only until the end of the residence permit. If you come to the Ministry of Internal Affairs to renew your status when it has already expired, the documents will not be accepted.
  • When a person did not know that the residence permit is extended within a certain period of time, or forgot about it, there is only one action left - to leave the Russian Federation after the expiration of the status. Next - either return to your homeland, or enter Russia and start from scratch - from applying for a temporary residence permit to obtaining a new residence permit.

Rules for extending a residence permit in St. Petersburg

The validity of the document is extended five years after issue. What you need to do for this:

  1. Submit an application for extension;
  2. Provide 4 3x4 photos, a current residence permit and a passport.

The deadline for applying to the Main Migration Department of the Ministry of Internal Affairs is 60 days before the end of the current document, it is better to do this even earlier. The processing time for the application is two months. The usual renewal period for a residence permit is five years.

There is also a state fee of 3.5 thousand rubles for the procedure. If the decision is positive, the citizen will be notified of this within three days. Then a certificate is issued stating that the residence permit is subject to a 10-day extension.

To obtain a residence permit, you need to live in the Russian Federation for at least a year and have a temporary residence permit (does not apply to refugees, VSK, people with Belarusian or Turkmenistan citizenship, native speakers). If there are unlawful refusals to submit an application or issue a document, you should write complaints, or, as a last resort, go to court.

What documents need to be prepared?

The list of securities may differ in different regions. Here is the standard kit required for submission

1. Statement.

A special form is used for the procedure. Download the current application form, valid from 2021, at the end of the article.

A form filled out both by hand and on a computer is suitable. If you write by hand, the handwriting should be legible and easy to read.

2. Passport.

Plus you will need a notarized copy of the document.

3. Residence permit.

When foreigners come to renew their status, they are usually asked to make copies of all completed pages of the document.

4. A check confirming payment of the state duty.

The residence permit is not extended free of charge. The price for the service, as when obtaining status, is 3,500 rubles. It is convenient to generate a receipt for payment through the website of the Ministry of Internal Affairs. Payment is made through the Sberbank cash desk. In some regions, payment is available through terminals and Sberbank online.

5. Photos.

You will need 4 photos. Required photo size: 35 x 45 mm.

6. Certificate confirming knowledge of the Russian language.

If you have a certificate or diploma received in the Soviet Union before 91 or in the Russian Federation, a certificate is not needed.

What other documents may be requested?

The lists of documents differ in different departments. If renewal is just around the corner for you, visit your OMV and check the package of papers. Additionally they may require:

  • TIN
  • Certificates confirming income
  • A copy of the marriage certificate
  • Annual notification receipts for all five years
  • A copy of the employment contract

Why do employees of the Ministry of Internal Affairs refuse to renew their status?

The grounds for refusal are given in clauses 55 – 56 of the Regulations of the Ministry of Internal Affairs for the issuance of residence permits (Order of the Ministry of Internal Affairs of November 9, 2021 No. 846).

The most common reasons for refusal:

  • The migrant's income level is below the subsistence level
  • The foreigner did not give annual notice
  • A foreign citizen received two or more administrative fines in a year in the following areas: violation of public order, violation of residence rules, drug trafficking
  • The status will not be extended if restrictions are applied to the migrant in the form of undesirability of staying in the Russian Federation or refusal of entry permission
  • A long stay abroad (more than six months a year) may also make extension impossible.
