Legal status of the DPR and LPR

The new territories have not yet received recognition from any state. The only country that considers them independent is South Ossetia. But she herself has a limited legal status. The largest interstate organizations - the UN, the European Union, the CIS - refused to fully or partially legalize the existence of unrecognized quasi-state entities. The lack of legal norms does not prevent the implementation of a policy of informing the population about the situation surrounding the conflict. For this purpose, Representative Offices of the DPR have been created in European countries:

  • Czech Republic;
  • Greece;
  • France;
  • Finland.

The first state in which information centers of both republics opened was Italy. The activities of these organizations in EU member states do not have legal force, but contribute to a gradual change in the attitude of the population towards the procedure for unofficial recognition of the temporary status of self-proclaimed states. The leadership of the republics currently has no other effective legal and socio-political instruments.

What features does a passport have?

Legally, the owners of new documents are considered citizens of Ukraine. Old ID cards will not be confiscated. Residents of the DPR who have reached 25/45 years of age do not have to submit previously received papers. The change procedure is similar to the Russian system. For Lugansk residents, the document has pages for inserting photos. The DPR passport does not have the usual two-letter definition of the series. It is replaced by two-digit numbers:

  • code;
  • year of issue.

The document number consists of six digits. In the LPR, the identification structure has not changed compared to Ukraine. The forms have several degrees of protection - watermarks, raised printing, kipp effect. DPR and LPR passports are not valid in Ukraine. Crossing the demarcation line while carrying any items in any way connected with the republics is dangerous for their owner. In addition to the passport, these may include:

  • other documents issued by official bodies;
  • trademarks;
  • symbolism.

Informational materials containing texts or images mentioning unrecognized entities should not be transported into the territory of Ukraine.

Who is eligible to receive a passport?

Of those who live in territories that have renounced the jurisdiction of Ukraine, the persons listed in the table can become holders of a new passport.

You can also get a new passport if:

  1. The old one is stolen, lost or damaged.
  2. The questionnaire needs to be corrected.

Registration in the DPR is changed only if there is a valid address certificate. Additional information is entered according to the official data provided by the applicant. Work in the DPR is not indicated in the issued document.

DPR passport for residents of the Donetsk region

Citizens who lived in the region or were registered in the specified territory as of 04/07/14 have the right to receive P. Let's consider the basic grounds for receiving P. for the specified category of persons.

  1. The citizen was registered (registered) in the territory of the Donetsk region, about which there is a corresponding stamp in the Ukrainian P. In this case, receiving a republican P. is “automatic”. The basis for receiving will be a P. citizen of Ukraine with registration in the Donetsk region. However, there is one caveat. The locality in which a citizen is registered in the region can be located both on the territory of Ukraine and on the territory of the Republic.
  2. If the settlement is located on the territory of Ukraine, you will additionally need to issue an address certificate confirming the fact of registration of your place of residence on the territory of the republic at the time of submitting documents to the migration service.

Design features

The Ministry of Internal Affairs of unrecognized states responsible for compliance with the procedure issued orders:

  • in the DPR – No. 182 of March 15, 2016;
  • in the LPR – No. 526 dated 08/23/2016.

DPR

The list is not very large, it is easy to prepare. The documents required to obtain a DPR passport are provided in original form and in copies:

  • Ukrainian identity card;
  • individual tax number;
  • birth certificate (your own and all minor children) and marriage certificate.

The same applies to legal notices of divorce. Attached to the documents:

  • four photos measuring 35x45 mm;
  • address certificate (in the absence of information about the place of residence or when issued by another territorial body);
  • registration with the housing office according to form A;
  • receipt of payment of the duty (250 rubles);
  • confirmation of official employment (for civil servants and military personnel - with official seal).

An address certificate must be attached to the package of documents if an identity card is issued at a location other than your place of residence.

LPR

There are no particular discrepancies regarding what documents are needed to obtain a passport of a citizen of the LPR. The list is similar to the list compiled by the DPR:

  • official Ukrainian identity card;
  • TIN;
  • birth, marriage or divorce certificates.

All documents are attached to the application. A sample of filling out the form can be found at the information stand for those wishing to obtain a passport. Repeated issuance in the LPR costs 490 rubles, plus a fee of 80 rubles. If it is not possible to prove that the applicant lives in the republic, the documents must be accompanied by a court decision and confirmation of the passport holder’s permanent residence at the address indicated by him.

What documents do residents of the DPR and LPR need to obtain a passport of the Russian Federation?

Russian President Vladimir Putin signed a Decree on simplified receipt of Russian passports by residents of certain areas of the Lugansk and Donetsk regions of Ukraine. “To obtain a Russian passport, residents of the LDPR will need to go to the branches of the Russian Ministry of Internal Affairs on the territory of the Russian Federation. The specific addresses of the departments of the Federal Migration Service where applications will be accepted will be announced by the security forces. Most likely, these will be the Federal Migration Service in the Rostov and neighboring regions. (Authorities from the migration service will also work, who will accept documents in the republics and forward them to the Russian Federation - Ed.) After a person’s package of documents is accepted, he will have to wait three months. Then the Ministry of Internal Affairs issues a notification about his acceptance of Russian citizenship,” said Daniil Bezsonov, head of the press service of the People’s Militia of the DPR.

For this you need the following documents:

application for citizenship;

passport of the DPR or LPR with registration within these territories;

marriage and divorce certificate (if one is available);

document confirming the change of surname, name or patronymic;

passport of a citizen of Ukraine - general civil or foreign;

child's birth certificate (minor children will receive Russian citizenship from one of the parents by including the mother or father in the application).

In addition to the originals, you must also have notarized copies of documents. In particular, they must be translated into Russian.

At the same time, people will not have to send a renunciation of Ukrainian citizenship to the Ukrainian consulate.

After receiving notification of citizenship, you can go to apply for a general passport, the production of which takes 10 days. To do this, you need to have the notification itself, a DPR or LPR passport, birth certificate and photographs.

Where to go

Ten calendar days are allotted for issuing an identity card. But the standard processing time for a passport is one and a half months. The DPR Migration Service, like a similar body in the LPR, receives citizens in the following territorial structural units:

  • Donetsk Republic - 32 branches opened. Receiving advice on passport issues - in the public ( [email protected] ) and electronic (https://mvddnr.ru/public-reception) reception of the Ministry of Internal Affairs or the sectors of the migration service at the place of residence;
  • Lugansk Republic - 15 branches have been opened. Answers to pressing questions are provided by specialists from the Migration Service Department of the Ministry of Internal Affairs of the LPR (Lugansk, Kotsyubinskogo St., 2) and its territorial divisions. Reception is held on Tuesdays, Thursdays, Fridays and Saturdays.

Passport offices in the LPR and DPR operate from 9.00 to 17.00. The usual number of working days is four. On Saturday, citizens are received until 13.00. Taking into account internal regulations, it is necessary to plan additional time to register information about registration and family composition.

Algorithm of actions for obtaining a document

After preparing the necessary official papers, you need to do the following:

  • apply;
  • issue a personal card;
  • get a passport.

Information about registration at place of residence, marital status and family composition must be entered on the pages established by the procedure for filling out. Men who have reached the age of 18 must additionally apply to military commissariats to register for military service.

Who can be denied

The Ministry of Internal Affairs has the right not to give the applicant a positive answer if he:

  • openly speaks out for changing the constitutional structure of the republic;
  • committed forgery of documents;
  • When creating the database, he provided false information about himself.

Those who are members of prohibited political parties and associations, law enforcement officers or military personnel of the Armed Forces of Ukraine may be denied passports. Members of extremist associations who are being prosecuted for committing illegal or criminal acts may also not receive an identity card.

Who issues DPR passports?

As you know, the Migration Service of the DPR Ministry of Internal Affairs is responsible for processing and issuing passports. For citizens wishing to obtain a passport of the Donetsk People's Republic, it is necessary to contact the sector of the Migration Service of the Ministry of Internal Affairs of the DPR at their place of residence with an application and provide a package of documents, namely:

  • application for the issuance of a passport, filled out in typewritten form by an employee of the territorial division of the Migration Service on the basis of original documents provided by the person who applied for a passport. The correctness of the personal data entered into the application for a passport is confirmed by the personal signature of the applicant on the printed application. The personal signature of an individual on the application is certified by an authorized employee of the territorial unit of the Migration Service. If a person is unable to sign independently, an employee of the territorial unit makes a corresponding entry in the “Official Notes” column. When submitting an application for a passport, the applicant is photographed and the digital photo is included in the application for a passport;
  • birth certificate. If a citizen does not have a birth certificate, he is recommended to contact the state civil registration authority at the place of birth registration or place of residence to obtain a repeat birth certificate. If it is impossible to provide a birth certificate (repeated birth certificate), a passport may be issued on the basis of other documents confirming the information necessary to obtain it;
  • two personal photographs in black and white or color, size 35 x 45 mm, with a clear image of the face strictly from the front without a headdress. For citizens who constantly wear glasses, it is mandatory to take photographs with glasses without tinted lenses. The surname and initials of the passport holder are indicated on the back of the photographs;
  • documents indicating membership in persons entitled to receive a passport of a citizen of the Donetsk People's Republic (if it is necessary to confirm the status of the person applying for a passport);
  • documents confirming the grounds for replacing the passport;
  • documents (originals) necessary for making mandatory marks in the passport (birth certificates of children under the age of sixteen, marriage certificate, documents confirming registration at the place of residence);
  • a receipt for payment of the republican duty or a copy of the document on exemption from payment;
  • in case of theft/loss of a previously issued passport of a citizen of the Donetsk People's Republic - a certificate from the internal affairs bodies about registration of this fact with the internal affairs body at the place of registration of residence/place of application;
  • documents confirming the fact of changes in personal data.
  • The applicant provides original documents and their copies, which are certified by an employee of the Migration Service, and the original documents are returned to the applicant.
  • Persons entitled to receive a passport in accordance with the requirements of subparagraphs 10, 11, 12, 14 of paragraph 2.1 of section II of the Temporary Regulations on the passport of a citizen of the Donetsk People's Republic, approved by Resolution of the Council of Ministers of the Donetsk People's Republic dated 02/12/2016 No. 1-13 as amended and additions approved by the Resolution of the Council of Ministers of the Donetsk People's Republic of March 10, 2017 No. 3-41, it is necessary to submit a declaration stating that the child was not documented with a passport of citizenship of Ukraine or another state

The period for obtaining a passport is 1 month.

In case of any difficulties, the period for obtaining a passport can be extended to 2 months.

When applying for a DPR passport, the applicant’s Ukrainian passport is not confiscated!

Passports are issued and replaced by territorial divisions of the Migration Service at the place of registration in the following cases:

  • reaching the age of 16 years;
  • reaching the age of 25 years;
  • reaching the age of 45 years;
  • loss (theft) of a passport;
  • changes by a person in the established order of last name, first name, patronymic;
  • the passport is unsuitable for further use due to wear, damage or other reasons;
  • detection of inaccuracies or errors in entries made in the passport;
  • changes in appearance as a result of injury or surgery, as a result of which it is impossible to identify the person from a previous photograph.
  • Refusal to issue a DPR passport

The main condition for obtaining a passport of a citizen of the DPR is the presence of a Ukrainian passport and registration of place of residence (the so-called “propiska”) in the territory of the former Donetsk region at the time of the creation of the Donetsk People’s Republic, namely as of April 7, 2014.

If there is no registration of place of residence as of April 7, 2014, the Migration Service of the Ministry of Internal Affairs of the DPR refuses to issue and issue a passport for a citizen of the DPR!

What to do in this case? What should be done for persons who permanently resided in the territory of Donetsk, Makeevka, Gorlovka, Enakievo, Yasinovataya, Torez, Khartsyzsk, Shakhtersk and other cities that are currently part of the DPR, but they did not have registration of place of residence as of April 7 2014?

In this case, you must go to court. To go to court, you must prepare a package of documents, draw up an application, support the application with evidence, pay the court fee (as of November 28, 2016, the court fee is 400.00 rubles) and submit the application to the court of first instance at the applicant’s place of residence.

If residence is established on the territory of the DPR as of April 7, 2014, the court makes a decision, and with this decision, the citizen again applies to the Migration Service of the Ministry of Internal Affairs of the DPR with an application for the issuance of a passport.

The procedure for obtaining a passport is similar, only in this case the applicant must also provide a court decision.

A passport (hereinafter referred to as P.) is a document confirming that an individual belongs to the citizenship of a certain country and certifying his identity. The presence of this document provides a person with the opportunity to acquire rights and obligations for himself as a capable citizen. Does Russia recognize DPR and LPR passports today?

The legal specificity of the new documents is that until the political situation is resolved, the Federation continues to consider their owners as citizens of Ukraine. Passports issued on the territory of the DPR and LPR are recognized as valid in Russia according to the Decree of the President of the Russian Federation dated February 18, 2017. DPR passport for citizens of the Russian Federation

  1. Citizens of the Russian Federation can obtain a passport if they are or have been in public service, in internal affairs bodies, or in military service in the Donetsk People's Republic.   2. Obtaining a Passport is possible if foreigners, as of April 7, 2014, were officially registered at their place of residence in the region. Difficulties in obtaining Russian citizenship by residents of the Lugansk and Donetsk republics

Since the outbreak of hostilities, residents of the LPR and DPR have been turning to the official authorities en masse to submit applications for Russian citizenship. The general procedure applies to them.

Preparation of documentation

Grounds for obtaining a DPR passport for citizens of Ukraine

  1. As of April 7, 2014, the citizen lived in the Donetsk region, but was not officially registered (registered). In this case, a court decision will be required, which will establish and recognize the fact of residence in the territory of the region at the time of 04/07/14.
