Temporary registration at place of residence Printable version
As you know, every citizen of the Republic of Kazakhstan must have registration at the place of residence. In Kazakhstan, registration of the population at the place of residence and temporary residence has always been provided for by law.
There are 2 types of registration at the place of residence - permanent and temporary.
- Permanent registration is registration at the place of permanent residence.
- Temporary registration is registration at the place of temporary stay (residence) of a citizen for more than 1 month.
Citizens of the Republic of Kazakhstan who have reached of 14 (since by Decree of the Government of the Republic of Kazakhstan No. 30 dated 02/04/2020 “On amendments to the Decree of the Government of the Republic of Kazakhstan dated December 1, 2011 No. 1427 “On approval of the Rules for registration of internal migrants and amendments to some decisions of the Government of the Republic of Kazakhstan” registration of children under 14 years of age has been cancelled).
In this article we will dwell in more detail on the concept of “Temporary registration”, how and in what cases it is issued.
On January 7, 2021, amendments made to the Laws of the Republic of Kazakhstan “On Migration of the Population”, “On Housing Relations” came into force, which provide for the obligation of citizens to register at the place of temporary residence, as well as the obligation of owners or persons authorized to rent out housing to temporarily register citizens living in them.
New registration provisions apply to citizens who have temporarily changed their place of residence. People who come to visit, as well as on other business, for up to a month, may not register, as they are temporary residents.
The concept of “temporary residents” is defined in Article 2 of the Law of the Republic of Kazakhstan “On Housing Relations” (temporary residents are citizens who have been granted the right by a tenant (the owner of a home, a member of a housing cooperative) to temporarily reside in a home without charging them for the use of the home).
A citizen who arrives at a place of temporary stay for a period of more than 1 month is required to register within 10 days.
Where can I register and what documents are needed for temporary registration?
Registration of citizens at their place of temporary residence is carried out at the Public Service Centers (PSC) or through the “electronic government” portal. The registration procedure takes 10-15 minutes. The information is immediately entered into the information system, from which it is simultaneously transferred to the State Database “Individuals”. When submitting an electronic request for registration through the “electronic government” portal, the service “Temporary registration at the place of residence of citizens of the Republic of Kazakhstan” is selected. To do this, it is necessary to have an electronic digital signature of the service recipient and an electronic digital signature of the owner of the home to sign consent to registration in the “personal account”. When registering at a place of temporary stay (residence) through the portal, registration is carried out online.
Today, for temporary registration when applying to the Public Service Center, the following documents are required:
- consent of the owner of the tenant indicating the RKA code (or an authorized representative with a notarized power of attorney to register the tenant);
- identification document of the owner of the property (personal presence is required);
- identification document of the registered person.
It should be noted that registration at a place of temporary residence cannot be the basis for acquiring property rights and does not give the right to claim housing.
What does failure to comply with the rules of temporary registration entail?
Citizens residing at a place of temporary stay without registration are subject to administrative liability. Thus, residing at a place of temporary stay without registration for a period of 10 calendar days to one month entails a warning. After the end of the month, penalties in the amount of 7 MCI will be applied. Landlords who rent out apartments and do not register tenants in them will also be held administratively liable. The amount of the fine will be 10 MCI (at the same time, if the violation is repeated within a year, the fine will be 20 MCI).

Consular registration of citizens of the Republic of Kazakhstan in the Russian Federation
Good day, dear forum users. Our transition from “Kazakhstan” to “Russians” has finally been successfully completed. Since everything has been completed and there have been no problems and no fines, I want to share my experience.
When applying for Russian citizenship, it is necessary to attach to the documents a notarized statement of renunciation of Kazakhstani citizenship and a mail receipt that it was sent to the State Consulate. For the Federal Migration Service and registration of Russian citizenship, this application is sufficient. But only under the resettlement program and on the territory of the Russian Federation. This is where the discrepancies with the legislation of the Republic of Kazakhstan begin. When sending an application by mail, you do not cease to be a citizen of the Republic of Kazakhstan and are subject to laws as well as administrative penalties in connection with dual citizenship, illegal use of documents of the Republic of Kazakhstan, etc.. According to the law of the Republic of Kazakhstan, citizenship can only be renounced by personally submitting an application (and it is obligatory must have an exit stamp for permanent residence). the loss within 3 days and surrender your passports to the Republic of Kazakhstan. All these laws are publicly available on the website of the Civil Code of Kazakhstan.
Now how we did it. When applying for Russian citizenship, after waiting a month, we went to Kazakhstan and submitted the documents to register for permanent residence. After 35 days they arrived and took away papers with stamps (now they don’t put them in passports but give them on a stamped form, but I don’t take passports for a month), departure sheets, men’s forms stating that they had handed in military tickets. We had the opportunity to travel back and forth . They did this on purpose, since according to the law of the Republic of Kazakhstan, citizens of the Republic of Kazakhstan who have officially left for permanent residence are required to register with the consulate within 3 months (everyone does not have to go for registration, you can register by proxy). Receiving a temporary residence permit does not relieve the responsibility of registering with the Civil Code, since the temporary residence permit is Russian legislation. After receiving Russian Federation passports, the next day, I called the Civil Code and reported that yesterday the citizens’ full name. received Russian passports and lost (according to the same law of the Republic of Kazakhstan) citizenship of Kazakhstan. The girl asked the city of origin and wrote it down. She said that it is advisable to hand over the passports of the Republic of Kazakhstan as soon as possible. it was Friday. My husband went to Kazan on Sunday (the Civil Code is located there, which includes the Sverdlovsk region) with a power of attorney from me and my son. For those who don’t know yet, in Russia a power of attorney can be issued on one form by two people. My son and I wrote one for two and paid for one, just be sure to indicate “the right to sign and receive certificates. On Monday morning, the husband wrote 2 applications to the Civil Code, handed over his passports to the Republic of Kazakhstan and ordered a certificate of surrender of passports. at 16:00 I received the coveted certificates on a stamped form and went home safely.
