What is RVP?

TRP literally stands for “temporary residence permit.” A mark on the presence of a temporary residence permit is affixed to the internal passport of a citizen of a foreign state or a stateless person and confirms his legal residence in the territory of the Russian Federation.

What rights does this permission give:

  • Legally reside in the Russian Federation for three years. You can freely leave and enter the country for an unlimited time, but within the validity period of the permit;
  • Right to employment. If you do not have a temporary residence permit, you will have to buy a patent for the work or apply for a special permit. There is no need to do this with RVP;
  • The right to run your own business. To do this, it is not necessary to have Russian citizenship, but a temporary residence permit for living in the Russian Federation and engaging in entrepreneurial activity will be needed in any case.

Is it possible to extend the temporary residence permit?

The standard validity period of a temporary residence permit is 3 years, and it cannot be extended.

Note! According to Article 5.1 of the Federal Law “On the Legal Status of Foreign Citizens in the Russian Federation,” extension of the temporary residence permit in exceptional cases is still allowed for 180 days, but only at the discretion of the migration authority.

Six months before the expiration date of the temporary residence permit, you need to apply to the Department of Internal Affairs of the Ministry of Internal Affairs to obtain a residence permit. If you do not do this, you may be deported from the country after your permit is revoked.

Taking into account the goals of “staying” in our country, the actions of migrants after receiving permission may vary. However, there are a number of nuances, the implementation of which is carried out in a general manner, and which are mandatory for any category of foreigners, regardless of their goals and intentions to stay in our country.

All foreigners who have been legalized, as well as stateless persons, will have to register at their place of residence, annually confirm their temporary resident status and official employment.

Procedure after registration of a temporary residence permit

Registration

The first and most important thing you need to do after receiving a temporary residence permit is to register at your place of residence. You should apply for registration within 7 days after putting the mark, but it is best to apply for everything at once on the same day.

Important! For lack of registration, a foreign citizen with a temporary residence permit in the Russian Federation is subject to a fine of 7,000 rubles. If within 1 year you are brought to administrative responsibility twice on the same grounds, your permit will be revoked and you will be forcibly deported from the country.

How to register:

  1. If you are renting a home, you will have to negotiate with the owner. Apply for registration in another place, because Government employees occasionally check the residence of foreigners at their registration address, coming to “visit” them.
  2. Make an appointment at the Department of Internal Affairs of the Ministry of Internal Affairs at your place of residence. You can do this on the department’s website or through State Services.
  3. Come on the appointed day with the owner of the property and submit documents for registration at your place of residence.

The validity period of the registration is equal to the period of temporary residence permit – 3 years. It is automatically canceled upon termination of the permit.

In 2021, the state fee for registration at the place of residence is 350 rubles. You can pay it through a Sberbank branch or ATM. If you have a personal account in any other bank, money can be transferred through it.

Obtaining a TIN

The next and most important stage after obtaining a temporary residence permit is obtaining a residence permit. This should be done six months before the permit expires. A residence permit is the penultimate step on the path to Russian citizenship.

A residence permit is issued for a period of up to 5 years, but, unlike a temporary residence permit, you can renew it several times. If you are a native Russian speaker and have successfully confirmed this status, you will be able to obtain a residence permit for a period of 3 years. Who can apply for a residence permit without a temporary residence permit?

  • Native Russian speakers;
  • Foreigners who have children with citizenship or temporary residence permit in the Russian Federation.

Why is it necessary to confirm the status of a temporary residence permit?

In order for a foreign citizen to move and settle in our country, after receiving a temporary residence permit, a two-month period is given. During this period, he must not only settle in a new place, but also find an official place of work and register with the tax authority (obtain a tax identification number). The Migration Control Service will check all this data. In order to confirm the temporary residence permit, you must provide a separate package of documents to the Main Department of the Ministry of Internal Affairs of the Ministry of Internal Affairs:

  • completed notification form (form 21);
  • a photocopy of the foreigner’s passport of all pages (with all movements over the past period);
  • official confirmation from the place of work that the non-resident continues to work;
  • a document confirming income and payment of relevant tax deductions (2-NDFL).

Thus, the foreigner confirms his official stay on the territory of our country. This procedure is carried out annually for three years (validity period of the temporary residence permit).

Important! Absence of a foreign national for six months (continuously) will result in his permit being revoked.

Confirmation of temporary residence permit: where to go and what to take with you

So, exactly one year has passed since you received your temporary residence permit . Now you have exactly 2 months during which you must submit a notification to the Department of Internal Affairs of the Ministry of Internal Affairs at the place of your permanent registration. Although the regulations include a note that documents can be submitted electronically, in practice this is not yet possible. Documents must be brought in person, after checking with the visiting days and hours of your Ministry of Internal Affairs department.

Please note that the number of these same hours allocated for receiving notifications from temporary residence permits can be extremely limited, and the queues can be large.

The correct name of the procedure is “Notification of confirmation of residence in the Russian Federation” . In everyday life, such “terms” as “re-registration of temporary residence permit” or “confirmation of temporary residence permit” are common, but only one correct name is fixed in official regulations.

On the day of submission, you must have the following documents with you:

  • passport with RVP stamp and registration;
  • completed notification form (can be downloaded in the forms and samples section;
  • a document confirming the amount and source of income for the past year (not lower than the subsistence level of your region).

As practice shows, problems arise precisely with the last point. According to Law N 115-FZ, Article 6, such documents mean income certificates, copies of tax returns and other documents confirming the amount and source of income . The Decree of the Government of the Russian Federation No. 21 also does not specify the specific forms of papers suitable for these purposes. Thus, the law leaves the decision about which certificates are suitable and which are not to representatives of the Ministry of Internal Affairs . Therefore, different regions and branches may or may not accept different supporting documents.

How to fill out a notification for a temporary residence permit

In the annual notice of temporary residence permit, a foreign citizen must enter his personal data:

  • Last name, first name, patronymic
  • Residence address according to temporary residence permit
  • Employers and period of work for each over the last year
  • Countries and periods of departure from Russia (this information is entered only if the foreign citizen traveled outside the Russian Federation)

When residing on the territory of the Russian Federation under a temporary residence permit, a foreigner has the right to travel outside Russia for no more than 180 days per year. If a foreign citizen stays outside the Russian Federation for more than six months, his temporary residence permit will be cancelled.

First, let's understand the phenomenon of RVP itself. A temporary residence permit is the first stage of the standard naturalization procedure in Russia. It looks like a stamp in a passport and allows you to live in Russia for 3 years. A temporary residence permit is available under a quota, and if there are certain grounds, outside it. From November 1, 2021, these grounds are:

From November of this year, you can refuse a temporary residence permit by writing an application to the Department of Internal Affairs. A temporary residence permit can be canceled for a number of reasons:

  • actions that pose a threat to the security of the Russian Federation or its citizens;
  • support for extremist and terrorist activities;
  • history of administrative expulsion or deportation from the Russian Federation;
  • an outstanding or unexpunged conviction for a serious or especially serious crime;
  • falsification of documents, provision of false information about oneself;
  • bringing to administrative responsibility at least 2 times a year;
  • inability to legally support yourself and your family within the subsistence level;
  • after three years, lack of rights to use residential premises;
  • stay outside Russia for more than 6 months in total;
  • departure for permanent residence in another country;
  • drug addiction, positive HIV status (not in all cases), the presence of an infectious disease dangerous to others.

In most cases, a residence permit is a necessary condition for acquiring Russian citizenship. But, as you know, there are exceptions to the rules.

The final stage: obtaining a residence permit

If a foreigner plans to stay in Russia for a longer period than three years or forever, he must obtain a residence permit. What is not possible without a temporary residence permit (if he is not from the preferential category of foreigners (a resident of the post-Soviet space, born on the territory of the Soviet Union, a WWII veteran, a person whose specialty is of strategic importance for Russia, etc.)).

But the permit is valid only for a certain period (three years) and cannot be extended. Therefore, a residence permit is required, which is issued for a period of five years, and can then be extended a certain number of times. This is what makes this document useful. And to obtain citizenship of our country, the presence of such a document is simply necessary.

A residence permit is issued within six months, that is, after submitting documents, government authorities will consider the application and check the documents during this period. Therefore, a foreigner who has a temporary residence permit should worry about this in advance, before the expiration of the permit. A foreign citizen can begin this procedure a year after receiving permission.

Important! If a citizen of another state lives in the territory of the post-Soviet space and decides to move to our country under the “Compatriots” state program, then the consideration period will be reduced to two months.

Some nuances

If the regulatory authorities notice that a foreign citizen in any way (or actions) threatens the interests or safety of Russian citizens or the state itself, deliberately provided fictitious information about himself when applying for a temporary residence permit, or violated the law within a six-month period, the permit will be revoked. And it will not be issued again for ten years.

Having a permit in hand, a foreigner is allowed to work in our country and hold any position, if this does not contradict regional regulations, but only in the region where he received this permit.

Also, a foreign citizen with a permit in hand and having a permanent official place of work can apply for any credit products. You can apply for a loan at the bank whose terms and conditions stipulate such grounds for concluding a loan agreement, but the decision to issue a loan remains with the credit institution.

Having received a temporary residence permit, a foreigner has the right to obtain compulsory medical insurance, which gives him the opportunity to receive social insurance payments (sick leave).

As you can see, a temporary residence permit provides many opportunities and benefits for foreign nationals. The procedure for registering, confirming a temporary residence permit and then obtaining a residence permit is quite labor-intensive. The only thing a foreigner needs to remember is the mandatory adherence to deadlines and strict adherence to the norms of Russian legislation.
