Registration in a passport: the consequences of its absence


Is it allowed to obtain a passport without registration?

The issuance of a passport takes place in accordance with Decree of the Government of the Russian Federation No. 828 of 07/08/1997. It is this normative act (Article 11) that contains the list of documents that a person is obliged to provide to the department of the Ministry of Internal Affairs. This is an application, photographs and a birth certificate.

There is no mention of confirmation of the fact of permanent registration in the legislative act.

But there is Art. 10, which states that you can apply for or replace a document:

  • at the place of permanent residence;
  • at the place of stay;
  • at the place of application.

This means that a person is able to exercise his right while in a region/district where he has no registration at all. It is enough to contact the local authority of the Ministry of Internal Affairs in accordance with the established procedure.

If the passport is issued by a person living abroad, instead of a birth certificate, a foreign passport of a citizen of the Russian Federation is provided. The document must be translated into Russian. The above rules apply to all residents of the country, including children over 14 years of age.

It is possible to provide other documents only in individual cases and at the request of government employees. structures. The options under which an additional package may be requested are indicated in the Administrative Regulations approved by Order of the Ministry of Internal Affairs dated November 13, 2017 No. 851.

But registration still matters. This is due to the timing of the service:

  • at the place of permanent registration, the result is obtained in 10–14 days;
  • at the place of application or stay for a month.

Change upon reaching 20 and 45 years of age

The age of 20 and 45 obliges citizens to apply for a replacement passport to the Ministry of Internal Affairs or the MFC. The issue is also regulated by Government Decree No. 828. The application is submitted within a month after the occurrence of the above circumstances.

After submitting the package of documents, the applicant receives an identity card for the period of preparation of a new passport (no more than a month). Submission occurs at the place of residence, stay or application.

The replacement of a passport can be carried out by legal representatives of incapacitated persons. There is also the possibility for employees of government agencies to visit sick people to accept applications at home or in the hospital.

Recover in case of loss or theft

Further:

  1. Starting from 2021, it is prohibited to submit an application for passport restoration through State Services. To get a replacement, they come to the department in person.
  2. The employee records the request in a special journal.
  3. The victim is given a certificate of acceptance of the application.
  4. A case of loss (theft/theft) is opened.
  5. Information about the lost document is entered into the Mir database of the Ministry of Internal Affairs.
  6. A temporary certificate is issued (it takes 10 minutes to issue).
  7. The process of reviewing submitted documents and restoring a passport will take at least a month, regardless of whether the citizen applied at his place of permanent residence or in another district/city.

If the passport was returned after receiving a new one, it must be submitted to the Migration Department of the Main Directorate of the Ministry of Internal Affairs of Russia.

The situation is more complicated if the document was stolen, for example, abroad. You will have to go to the local police station and get a certificate of theft. Upon returning to your homeland, you will need to translate the certificate into Russian, have the translation certified by a notary, and contact the territorial police department.

The state fee for issuing a new passport form in Russia is 1,500 rubles. The restored passport is given back only after the owner’s personal signature. Formally, for careless storage of a document, which ultimately led to its loss, an administrative fine of 100-300 rubles is imposed.

Is a passport valid without a registration stamp?

The passport is valid. But failure to register may result in administrative penalties. There must be at least temporary registration, which is confirmed by a certificate.

Lack of registration also prevents large bank loans from being issued and does not allow the child to be assigned to a clinic, school, or kindergarten.

It will be more difficult to receive pensions or other social benefits (for example, child benefits). Without registration, you cannot exercise your right to participate in elections.

How to get a passport: step-by-step instructions

The service is available at any MFC (“My Documents”) or district department of the Main Department of Migration Affairs of the Ministry of Internal Affairs.

To receive a document offline:

  1. Fill out the application and submit it along with a package of documents to the MFC or directly to the Ministry of Internal Affairs.
  2. Pay the state fee of 300 rubles in any convenient way (at the police cash desk, bank, etc.).
  3. Obtain a confirmation slip and temporary ID (if required).
  4. Pick up your completed passport within 10–30 days.

Required documents:

  • birth certificate (if a passport is issued for a child over 14 years old);
  • old passport, if replacement occurs;
  • a foreign passport for those who have recently received citizenship;
  • documents for marks.

The list includes 2 photos (color or black and white) measuring 35 x 45 mm. Documents without photographs will not be considered.

In addition to traditional contact methods for submitting an application for the issuance/replacement of a passport, there is an online version of receiving the service through the State Services portal.

Remote filing gives you some privileges:

  • there is a 30% discount on payment of state duty (it will be 210 rubles);
  • saves the submitter's time;
  • subsequently, when visiting the Ministry of Internal Affairs, you can receive a completed document within 1.5 hours.

To submit an application online, complete the following steps:

  1. Go to the website: gosuslugi.ru in the “Passports, registrations, visas” section.

  2. Select the desired option from the list, fill out the application online and send it to the Ministry of Internal Affairs.

If for some reason a person was unable to appear at the Ministry of Internal Affairs department at the specified time after submitting an application online, the electronic form remains valid for another month. After this period, the application is canceled and you will have to go through the procedure again.

Minor citizens receiving an identity document for the first time will need to contact the territorial migration authority directly. The legislation does not provide for any other option.

How long can you stay without registration in your passport without being fined?

According to clause 3 of the Decree of the Government of the Russian Federation No. 713 of July 17, 1995 (as amended on May 21, 2012), every person is required to register at a permanent place of residence within 1 working week. If this period is more than 5 days, then the person will face administrative liability.

The period of 1 week allocated for registration applies only to those people who want to change their permanent place of residence. If we are talking about a temporary change of residence address, then the person has 90 days left.

Fine for lack of registration: is it legal?

Legal. In Russia, it is an administrative offense to live without temporary or permanent registration. Foreigners are required to register, as well as Russians who have moved to another region for a long-term stay (over three months).

A minor child is required to register at the place of residence of the parents within a week after receiving a birth certificate or moving to a new address. If you lose your permanent registration, you also need to register 7 days in advance (this may be a temporary registration).

Registration can be anyone. If it is not there or the deadlines for registration are violated, then according to the Code of Administrative Offenses the guilty person faces a fine of 2,000 rubles (Article 19.15.1). Living without a passport is also punishable. In this case, a fine of 2,000 to 5,000 rubles is imposed.

Types of registrations

In Russia for 2021, there are two types of registration:

  1. At the place of residence - permanent registration (in the old way - registration). It is issued when a person lives at the same address for a long time. Usually they do permanent registration if they have their own home, or if a relative is ready to register a citizen in his apartment or house. A distinctive feature, thanks to which a permanent registration cannot be confused with a temporary one, is the stamp that is placed in the passport.
  2. At the place of stay - temporary registration . It is issued when a citizen lives at a certain address not permanently, but for a certain period of time. They are registered temporarily, for example, in rented housing, in a dormitory, or a hostel.

One registration does not exclude another.

For example, a citizen who has a permanent residence permit in Krasnodar and moved to Moscow can make temporary registration in the capital. At the same time, registration at the place of residence is preserved.

Possible problems and nuances

According to the law, the lack of registration (temporary or permanent) is not a basis for refusal to issue a passport. But for example, obtaining Russian citizenship (the basis for obtaining a document) without registration is almost impossible (with the exception of immigrants).

Nuances when registering:

  • When a foreigner receives a passport, he or she will be warned that he or she must register within 7 days. Otherwise he will be fined.
  • It is also quite possible to obtain a foreign passport without registration. It is enough to present your internal passport and indicate the address of your actual residence. State fees for obtaining a foreign passport differ significantly (1000–3500 rubles).

Lack of permanent registration is not an obstacle to obtaining a passport. Employees of government agencies can refuse to accept documents only if not the entire package of documents has been provided or they do not comply with legal requirements.

What is the fine if there is no registration in the passport?

The amount of the fine is clearly stated in Art. 19.15.2 of the Code of the Russian Federation on Administrative Offenses No. 195 of December 30, 2001. It states that if a person does not have a residence permit in his passport, that is, he is not registered, then he faces the following punishment:

  • a fine of 2 to 3 thousand rubles;
  • for individuals - owners of residential premises where a person is registered - from 2 to 5 thousand rubles;
  • for officials - from 25 to 50 thousand rubles;
  • for legal entities – from 250 to 750 thousand rubles.

It should be borne in mind that the actions of a person who was not registered in the passport should not be criminally punishable. That is, a person should not commit a crime from which he subsequently tries in every possible way to escape.

If we are talking about a person who lives in Moscow or St. Petersburg, then for lack of registration he faces other fines. What is the fine for living without registration in the capital and the Northern capital?

The amounts of penalties are slightly higher than in other cities:

  • from 3 to 5 thousand rubles – for individuals;
  • from 5 to 7 thousand rubles – for owners of an apartment (house);
  • from 30 to 50 thousand rubles – for officials;
  • from 300 to 800 thousand rubles – for legal entities.

Speaking about real estate owners, officials and legal entities, we mean that these persons violate the deadlines for notifying the registration authorities that a citizen lives in the specified apartment.
