The procedure for carrying out labor activities of foreign citizens in Russia

The labor activity of citizens of other states in Russia is regulated by Law No. 115-F3 of July 2, 2002.

Foreigners have the full right to employment in the Russian Federation, which is allowed only when the foreigner reaches 18 years of age and if he has either.

About the employment process

The employment of Belarusians, unlike citizens of other states, has a number of features (according to Law No. 115-F3).

In particular, the following points are important in this area:

  1. Belarusians do not require a work permit.
  2. When hiring citizens of Belarus, it is allowed not to notify government agencies of the Russian Federation: the tax service, the employment service, the Main Directorate for Migration Issues of the Ministry of Internal Affairs.
  3. The clause of the law that prescribes restrictions on hiring persons who have arrived in Russia temporarily has nothing to do with Belarusians.

Such simplified registration of Belarusians for work in Russia is possible thanks to the presence of certain legal acts: the Treaty between the Russian Federation and the Republic of Belarus on equal rights of citizens (dated December 25, 1998); Decision No. 4 of the Council of Belarus and Russia (dated June 22, 1996); Treaty on the creation of the Union State (dated December 8, 1999).

Jobs requiring qualifications

Of course, jobs that require education pay higher. What’s interesting is that you can often get it already in the process: not all professions require a college or university diploma.

Bricklayer, taxi driver, machine operator

Bricklayer is a job in the field of construction. No education is required, but rather a willingness to demonstrate skills.

A taxi driver is a job that requires only the ability to drive a car and goodwill.

But a machine operator will need education - he will definitely be in demand, there will be no problems with the provision of housing, but working with agricultural machinery is still a difficult matter.

Forklift driver, delivery driver

A loader is a small, nimble machine that loads trucks and transports goods in a warehouse. Its drivers are constantly in demand, and they do not need too much training. That’s why they often just hire car drivers and train them on the spot.

A delivery driver is colloquially called a “truck driver.” Specialists in this field are always in demand, since cargo moves throughout the country constantly. The only education required is the ability to drive a truck.

The only negative is that sooner or later all truck drivers begin to have back problems.

Service Engineer

This is the person who ensures the operation of computer equipment. No enterprise can do without it.

Interestingly, knowledge in this area plays a much larger role than having a diploma. But it also has a strong bias: a man is more likely to be hired to work.

Excavator driver

While construction is going on, drivers for excavators are needed, and since construction is always going on, drivers are always needed. This shift work is considered traditionally male for Belarusians, but no one will forbid a woman to try it.

Dental assistant

The most popular vacancies and regions for Belarusians to work in Russia

Working in Russia is a real chance to earn additional income for Belarusians who are experiencing another economic crisis today.

Drivers and builders from our friendly republic are in particular demand in the Russian Federation. Official employment of Belarusians in Russia for such vacancies is possible both in large Russian cities (Moscow, St. Petersburg) and in other regions of the country (Siberia, Transbaikalia, the Far East, Sochi). There are also plenty of Belarusians who want to get a similar job, which is understandable: employment is completely official, and the procedure itself is simplified as much as possible; wages in Russian companies are several times higher than income received at home.

Belarusians also work in the “white collar” sector – as engineers, teachers, doctors, but blue-collar professions are still more popular.

Features of shift work

Many potential workers are interested in whether Belarusians can work on a shift basis in Russia, since most of them, as a rule, do not have their own housing on the territory of the Russian Federation.

Shift work is considered one of the most popular types of work among Belarusians. Working conditions vary depending on the specifics of the employment site and the region where it is located.

The duration of the shift also varies:

  • 20 days of work – up to 10 days of rest;
  • 45 days of work – up to 45 days of rest;
  • 60 days of work – up to 30 days of rest.

Shift duration is 11 hours per day.

When applying for a job on a rotational basis, the question naturally arises whether Belarusians need registration to work in Russia, which, as is known, is mandatory for foreign workers. Since December 2015, the period of time for citizens of the Republic of Belarus in Russia, which was already 30 days instead of the usual 7, was increased to three months. However, this does not apply to those who wish to study or work on long-term contracts: they must still adhere to the general rules.

As for professions, construction workers are most in demand for rotational service. If we talk about traditionally female vacancies, the most often required are cooks, cleaners, laboratory assistants, dispatchers, accountants, and commandants.

Where can I get a job?

Speaking about the areas of the economy where Belarusians are allowed to work in Russia, it should be taken into account that citizens of both countries have equal rights to employment. Therefore, they can be found in any region and in any sector of the economy, not excluding transport, for example, as taxi drivers. Moreover, Belarusian drivers, unlike other foreigners, are allowed to use driver’s licenses issued in their own state.

Vacancies: unskilled labor

A person who has a good, in-demand education will find a place for himself in any country. Another thing is those people who have no education. For them, working as a shift worker in Russia is a really good option.

Nurse, housekeeper, cleaner

For emotionally stable women who do not have specific skills, but learn easily and have a good level of empathy, the position of a nurse would be a good job.

Ladies of this profession are always in demand, they are often hired for permanent residence, their pay is decent - from 40,000, in the absence of education. Meals are provided by the employer, the main task is to look after the elderly.

Carers are often sought after for a pensioner with early-onset dementia who requires minimal assistance and supervision.

They are also hired for bedridden patients who need complete care, from feeding to changing diapers. The work is emotionally difficult, but it can be a good start.

Over time, you can take nursing courses: nurses with medical education are valued higher.

If your emotional stability is poor, you can become a housekeeper. They are hired for accommodation less often, but the work is not so exhausting and requires, for the most part, basic cleaning skills and neatness.

And, of course, you can become a cleaner. Accommodation is usually sought either for families or for production. It's physically hard work, but it's also a good place to start.

Hotel maid, dishwasher

If living with a family seems tiring, there are two other common jobs for women:

  • maid at the hotel. You need to live at the same hotel, the main task is cleaning the rooms. There are two disadvantages: maids are fined for customer complaints and fired without regret, since new ones are easy to find. But they pay here the same 40,000;
  • A dishwasher gets paid less than a maid, but she doesn't have to interact with people. She works with gloves, washes the dishes brought by the waiters, and the only negative she encounters is that her legs and back hurt after her shift. If you work as a washer for a long time, you can get allergic dermatitis, varicose veins and problems with the spine.

But these are also good vacancies for a start: maids are accommodated in a hotel, and washers are given a hostel.

Administrator, packer

An administrator or a packer is a job in Russia on a rotational basis for which not only women, but also men are hired:

  • administrator usually means in a hostel or hotel. His task is to receive calls from clients, register them, meet them, solve problems during their stay, and then discharge them. The schedule is usually variable - 2/1. You are supposed to live in the same hostel. Knowledge of English will be a big advantage, since there are usually many foreigners among the residents;
  • Packers are usually hired on shifts, with a schedule of a month at work and a month at home. The work is physically difficult, but the pay is good, plus they give you a uniform and, if you find a good employer, they can even give you a raise. The accommodation is usually a dormitory.

Administrator is a job in Moscow for Belarusians that allows sociable, articulate people to realize their potential. If everything goes well, you can gain a foothold in the tourism business and even go to study.

A packer is for those who like to work in a relatively calm atmosphere, with raw materials, and not with people.

Car washer, picker

In Russia, men are usually hired as car washers and assemblers - this work requires physical endurance. At the same time, order pickers have no prospects for career growth, but a car wash worker may one day move into a cashier’s chair or even become a car mechanic.

Construction worker

In Russia, Belarusians are more willing to hire men for this shift work. This is understandable: those tasks that do not require specialized education are easier to complete for a physically strong person, and there are more such people among men than among girls.

In addition, laborers are usually recruited in teams, grouped according to gender.

The work is physically difficult, but the pay is good. Plus, you can undergo training directly at the enterprise and master the construction profession: for example, learn how to stretch ceilings or lay tiles.

Documents required for employment

Since citizens of the Union State have the same rights and guarantees when hired in the Russian Federation, the question of what documents Belarusians need to work in Russia, as a rule, does not arise either for a new employee or for the personnel department. It goes without saying that the list of documents when hiring a Belarusian will be the same as in the case of employing a Russian, that is, in accordance with the Russian Federation.

You must bring to the HR department:

  • passport of a citizen of the Republic of Belarus;

Features of concluding an employment contract

Concluding an employment contract with a Belarusian, unlike the same procedure with another foreigner, is not difficult, especially if the new employee presents an old (Soviet) type work book. Such books are valid in the Russian Federation today, so a record of work can be entered into it immediately.

What to do and how to register a Belarusian for work if he has a work book of a new (post-Soviet) type, which is considered foreign in Russia and is not recognized on the territory of the state? Russian license when working as a driver in the Russian Federation: is it necessary to obtain one?

When employing citizens of a friendly republic in Russia, there is another bonus that concerns the transport industry. Unlike other foreigners, Belarusians do not need to change their national driver's license to a Russian one. Is notification required when hiring Belarusians?

Despite the simplified employment procedure, Russian employers still have doubts about whether it is necessary to notify the Main Directorate for Migration Affairs of the Ministry of Internal Affairs about hiring a Belarusian. It is necessary to register a citizen of Belarus for migration registration with the territorial body of the Main Directorate for Migration Issues, but there is no need to notify the tax service and employment service.

It is better not to neglect and delay in registering a Belarusian employee for migration registration, because if you do not notify a Belarusian of hiring a Belarusian in a timely manner, a fine may well be imposed for this.

Taxation nuances

The income of an employee who has citizenship of the Republic of Belarus is taxed at a rate of 13% in two cases:

  • when concluding an open-ended employment contract;
  • when concluding a contract for a period of more than six months.

The income tax of an individual will be 30% only if by the end of the year the stay in the Russian Federation is less than six months (183 days), since in this case foreign citizens, including those with a Belarusian passport, according to the Tax Code, are not considered taxable residents of the Russian Federation.

A special tax rate (13%) is valid only for residents of Russia, while for citizens of Belarus this status is established from the moment of concluding an employment contract, the total period of stay in the country is not taken into account.

Step-by-step instructions in case of dismissal:

  • the territorial body of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs of the Russian Federation must be notified of the termination of the employment contract; a period of 3 working days is given for this (clause 8 of Article 13 of Law No. 115-F3);

Hiring a Belarusian to work in the Russian Federation in 2021 is an extremely pressing topic for many Russian employers.
