About the status of “temporary asylum”
There are many reasons that encourage Ukrainians to leave their homes and travel to another country, with the lack of security and stability being probably the most important. This is what forces Ukrainian citizens to leave their homes.
Arriving in the Russian Federation, they most often apply for refugee status or temporary asylum.
The concept of “temporary asylum” was first introduced in 1993, which suggests that its appearance has absolutely nothing to do with the events currently taking place in Ukraine.
Temporary asylum gives a foreign citizen the right to stay in the Russian Federation on a short-term basis; it can be obtained in two cases:
- if there are grounds for filing an application for refugee, but the applicant prefers to apply for temporary asylum;
- there are no grounds for obtaining refugee status, but there are factors that do not allow, for humane reasons, to deport a foreign citizen outside of Russia. These include health status (the applicant is not able to receive help in his home country) or the presence of a threat to life (hunger, military conflicts, epidemics).

What is refugee

This means that the owner of the certificate has the right to temporarily stay on Russian territory and cannot be expelled from it against his will. And although the provision of temporary asylum to Ukrainian citizens in Russia has nothing to do with citizenship, it still gives them some rights. So, let’s say, in the matter of social protection, the life of arriving Ukrainians will not be much different from what Russians enjoy.
If, for example, they have reason to take advantage of the Compatriot resettlement program, then the rights and responsibilities of Ukrainians when obtaining temporary asylum can be expanded. Typically, such applicants include persons who were once citizens of the RSFSR or are of Russian origin.
All potential “immigrant” participants have the opportunity to undergo a further legalization procedure in a simplified manner, but this does not exempt them from obtaining a temporary residence permit or from registering at their place of residence.
The possibility of going through a simplified procedure for obtaining Russian citizenship is enshrined in Part 7 of Article 14 of the Federal Law “On Citizenship of the Russian Federation”: a citizen of Ukraine will be able to become the owner of a Russian passport only after 3 years of residence in Russia on the basis of a residence permit.
In addition, after obtaining temporary asylum status, migrants from Ukraine have the opportunity to work freely in the Russian Federation and do not need to obtain any additional documents.
Forms for extending temporary asylum

What benefits can Ukrainians count on?
At the stage of legalizing their position or in the process of further residence, Ukrainians can count on:
- to receive interpreter services;
- for registration of a medical policy and provision of medical services provided for by the policy;
- for education and a place in kindergarten;
- to receive financial assistance.
As for financial support, its amount may vary depending on the region in which the migrant will live.
We should not forget about the assistance received by immigrants from Ukraine who take part in the resettlement program for compatriots.
But at the same time, persons granted asylum do not have any other benefits or advantages over other migrants or Russians.
Procedure for obtaining temporary asylum
In order to be able to stay in the Russian Federation legally, the applicant must submit an application to the department of the Main Department of Migration Affairs of the Ministry of Internal Affairs at the place of his residence.
An application for temporary asylum for Ukrainians is drawn up according to a strictly established template for all family members who intend to stay in the Russian Federation.
You can only contact the authorized body in person; electronic appeal is not provided in this situation; registration with migration authorities is not required before submitting the application.
After the document is accepted, the service employee must interview the applicant and fill out a questionnaire based on this conversation. If necessary, the candidate must be provided with an interpreter.
The questionnaire contains the following information:
- personal information;
- reasons for filing an application to the Ministry of Internal Affairs of the Russian Federation.
After completing the application form, you will have to undergo an interview regarding the reasons that prompted the applicant to seek asylum. All information is recorded in the protocol. After studying the drawn up documents, the candidate will have to sign them. He should be patient, since he will not be able to obtain temporary asylum in Russia right away.
After completing all the formalities listed above, the applicant is issued a certificate confirming that the documents are under consideration. The period of its legitimacy is the entire period of waiting for a decision on the request. Only after receiving such a certificate should Ukrainian migrants register with migration authorities at their place of residence.

It is issued within one day following the date of the decision. To complete it, a photo of the applicant and children, who must be indicated in the certificate, is attached to the package of papers. You can only receive the document in person; no exceptions are allowed in this case. In this case, the migration service confiscates the national passport from the Ukrainian citizen.
How long is the certificate valid and can it be extended?
Temporary asylum in the Russian Federation is granted to a foreign citizen for a period of up to one year; the law allows for the extension of the status of temporary asylum, which involves filing an application in a free format, but with a mandatory indication of the circumstances that force the applicant to extend his status. The application must be submitted no later than a month before the expiration date of the document; if there are valid reasons, the allotted period of time can be extended by another 30 days.
The public service that decides whether to extend temporary asylum to a Ukrainian in Russia or deny it is the territorial body of the Main Directorate for Migration Issues of the Ministry of Internal Affairs, where the applicant is registered. It is by the decision of the migration service department that this status can be extended an unlimited number of times for each subsequent year.
In addition, there is no fee for carrying out this procedure.
Thus, it is not so important to know how many times temporary asylum can be extended for citizens of Ukraine; it is much more important to be aware of the reasons why they may be denied or even deprive their status.

Can asylum be refused?
You need to be prepared for the fact that the commission’s decision may not always be made in favor of the applicant, and asylum may be denied.
The reasons for refusal are most often given as follows:
- lack of a passport - remember that stateless persons can also obtain status;
- there is no evidence of legal stay in the Russian Federation, but even if you arrived illegally, you have 24 hours to contact the migration service (in all other cases, a migration card can serve as the basis);
- there are some indications in the documents that the applicant lives in another Russian region - documents are accepted at the place of residence, not registration, therefore redirection to another department of the Main Department of Migration of the Ministry of Internal Affairs is unlawful;
- absence of a rental agreement (though there is no such document in the list of papers);
- violation of deadlines for certificate renewal;
- non-compliance with the rules of stay.
How to fill out an application for temporary asylum for Ukrainians
If a foreign citizen for any reason (for example, due to ignorance of the Russian language, illiteracy, etc.) is not able to independently prepare an application for temporary asylum in the Russian Federation, then this document must be filled out by an official of the territorial body of the Ministry of Internal Affairs of Russia. I would like to note that Russian legislation does not require the applicant to compulsorily complete migration registration at the place of stay before submitting this application.
